Extraordinary Reduction of the Fine
Abstract:
Tato práce úzce pojednává o institutu mimořádného snížení výměry pokuty nově zavedeném v zákoně č. 250/2016 Sb., přestupkový zákon. Pomocí tohoto institutu má správní orgán oprávnění snížit pokutu za přestupek pod dolní hranici zákonné sazby. Cílem práce je shrnout dosavadní poznatky k tomuto institutu a provést rozbor jednotlivých aspektů (zejména podmínek) aplikace institutu v praxi. S pomocí analýzy …more
Abstract:
This thesis closely deals with the institute of extraordinary reduction of the amount of the fine newly introduced in Act No. 250/2016 Sb., the Misdemeanour Act. Using this institute, the administrative authority is authorized to reduce the fine for the misdemeanour below the legal limit.
