Abstract:

Věřitel má možnost uspokojit svou pohledávku nejen s pomocí soudního exekutora, ale i s dražebníkem veřejných dražeb. Dle mého názoru je první z těchto možností využívána daleko více, jelikož veřejnost nezná výhody veřejných dražeb. Ve své bakalářské práci proto porovnávám veřejné dražby dle zákona o veřejných dražbách s dražbami soudních exekutorů dle občanského soudního řádu a exekučního řádu. V první a druhé části popisuji oba dražební systémy. V další části zdůrazňuji největší rozdíly těchto systémů. V poslední části zhodnocuji vybrané prvky, vysvětluji klady a zápory obou systémů a navrhuji možné úpravy k větší efektivitě dražeb.

Abstract:

A creditor has the possibility to settle a claim not only with the help of a court distrainer, but also with a system of public auctions. In my opinion, the first option is much more used because the public does not know the advantages of public auctions. In my bachelor's thesis I compare the public auctions under the Act on Public Auctions to the court distrainer auctions under the Civil Procedure Code and Execution Procedure. In the first and second part I describe both auction systems. In the other part I highlight the major differences of both systems. In the last part I assess chosen elements, explain the advantages and disadvantages of both systems and suggest possible modifications for greater effectiveness of the auctions.
