Debt discharge of a married couple before and after an Insolvency Law revised amendment

Abstract:

Insolvenční zákon stanoví, že dlužník je v úpadku, jestliže má více věřitelů, peněžité závazky po dobu delší než 30 dnů po lhůtě splatnosti a tyto závazky není schopen plnit. Zjištěný úpadek lze řešit několika způsoby, kterými jsou konkurs, reorganizace a oddlužení. Insolvenční řízení se zahajuje zásadně na základě návrhu. O způsobu řešení úpadku rozhoduje soud.Návrh na povolení oddlužení může podat jen dlužník. Před revizní novelou insolvenčního zákona účinnou od 1.1.2014 právní úprava insolvenčního řízení neznala institut společného oddlužení manželů. Tento institut byl nejprve vytvořen judikaturou.Velkou revizní novelou insolvenčního zákona došlo ke kodifikaci institutu společného jmění manželů. Manželé mají postavení nerozlučných společníků a pohlíží se na ně jako na jednoho dlužníka. Protože insolvenční zákon je poměrně mladý a judikatura s ním spojená není ustálená, liší se často rozhodovací praxe jednotlivých soudních senátů.

Abstract:

The Insolvency Act determines the conditions of the debtor´s bankruptcy - being due to more creditors, going on unpaid obligations even after thirty-day term or inability of payment. The revealed failure may be solved by several means - bankruptcy, reorganization, disencumbrance. On principle, the insolvency process can be opened after the debtor´s or creditor´s application. The court decides and recommends the method. In case of disencumbrance, only the debtor is authorised to require that. Before the review amendment of the Insolvent Act effective since 1st January 2014, our law modification of the insolvent process had not known the institute of common disencumbrance of a married couple. This institute was created by the judicature. The above mentioned novella of the Insolvency Act brought codification the institute of shared couple´s property. The both persons are considered to be inseparable partners and personalized as one debtor. The Insolvency Act is rather new and the corresponding judicature has not been constant yet. That is the reason why court senates and their decisions may differ.
