Domestic violence from the point of wiew of the Czech republic police

Abstract:

Zkoumaným problémem bakalářské práce je tématika domácího násilí z pohledu Policie České republiky. Zpracovaná bakalářská práce je rozdělena na dvě samostatné části a to na úvodní teoretickou část a druhou praktickou část, tedy část výzkumnou. Cílem teoretické části práce je ukázat pohled na problematiku domácího násilí ze strany policisty. Teoretická část práce obsahuje čtyři kapitoly, přičemž v první kapitole je rozebrán problém domácího násilí okolo nás. Práce se zde dále zabývá historickými souvislostmi a příčinami vzniku domácího násilí. Druhá kapitola práce podrobně vymezuje základní pojmy a poukazuje na závažnost tohoto společenského a sociálního problému. Třetí kapitola teoretické části práce je věnována prevenci a postižitelnosti domácího násilí v rámci zákona. Ve čtvrté kapitole teoretické části, jejíž součástí jsou i kazuistiky, tedy konkrétní případy z praxe autora, je popsán postup Policie České republiky při uplatnění zákona se zaměřením na nově zavedený institut vykázání. Závěrem této kapitoly je snaha ukázat pohled policisty na celý problém z jeho strany. Praktická část práce obsahuje jednu, tedy pátou kapitolu, kde jsou definovány cíle výzkumu, hypotézy, realizace a shrnutí výzkumu s ověřením hypotéz. Účelem výzkumu prováděného mezi policisty je ověření skutečnosti, zda je zkoumanému problému v naší společnosti věnována dostatečná pozornost a zda je domácí násilí v současné době efektivně postihováno a jaký je praktický účinek stávajících zákonných opatření. Zároveň jde o ověření teoretické připravenosti policistů realizovat stávající zákonná opatření.

Abstract:

The subject matter of this Bachelor thesis is the domestic violence from the point of view of the Police of the Czech Republic. The work is divided in two independent sections; the initial theoretical part and the latter practical, i.e. research part. The aim of the theoretical section is to demonstrate the approach to the issue of domestic violence from a policeman?s perspective. The theoretical section contains four chapters, the first one opening with the analysis of the domestic violence around us. The chapter further unfolds the historical context and the motives that initiate domestic violence. The second chapter defines the basic terminology and points out the seriousness of this communal and social problem. The third chapter of the theoretical section studies the prevention and criminal sanctioning of the domestic violence within the law. The fourth theoretical chapter, which also includes cases, i.e. concrete examples from the author?s experience, describes the procedure of the Czech Police forces practising the newly established principle of expulsion. The conclusion of this chapter aims to portray the problem from a purely policeman?s perspective. The practical section of the thesis contains only one, the fifth and final chapter that presents the objectives of the research, the hypotheses, the realization, and the resume of the research based on verification of the hypotheses. The aim of the research effectuated among the policemen is to verify whether the examined problem is given enough attention in the society, whether the domestic violence is at present day effectively penalized, and what are the consequences of the existing legal measures. Simultaneously, it studies the theoretical readiness of the policemen to exercise the current legal measures.
