Protection of Personality in Recent Judicial Practice

Abstract:

Tématem této práce je rozbor aktuální soudní judikatury ve sporech na ochranu osobnosti. Autor, soudce specializovaný na tuto problematiku, k problematice přistupuje kombinací systematické a analytické metody a rovněž kazuisticky ilustruje teoretické otázky na praktických případech. Řadu sporů na ochranu osobnosti lze bez jakékoli nadsázky označit za hard cases. Těmi se rozumí případy, k jejichž řešení buď schází normativní úprava nebo ohledně nichž na základě existující úpravy korektní, tj. v právním myšlení obvyklou aplikací standardních interpretačních postupů, lze dospět k diametrálně odlišným řešením. V této práci je kladen obzvláštní důraz na související judikaturu. V některých pasážích přihlíží práce také ke koncepci návrhu nového občanského zákoníku, k vrcholnému dílu evropské deliktní doktríny - Principles of European Tort Law a k Civil Code of Québec. Práce se postupně zabývá problematikou pramenů práva na ochranu osobnosti, pojmem tohoto práva, aktivní a pasivní legitimací při ochraně osobnosti a právními prostředky ochrany osobnosti.

Abstract:

Subject of this paper is devoted to an analysis of a recent case law relating to disputes on protection of personality. Its author, a judge with a professional specialisation on such disputes, deals with the subject by combination of a systematic and analytic method and he also demonstrates the theoretical issues on a ground of the real cases and decision making practice. A number of disputes on protection of personality can be called, without any exaggeration, the hard cases. This indicates the cases with a lack of relevant legal framework on which a decision can be based or the situations where the proper application, i.e. an usual application in the terms of a legal consideration, of standard interpretation procedures under existing legal framework leads to diametrically different conclusions. This paper puts a particular accent on a relating case law. In some of its parts the paper also takes into consideration a conception of a new Civil Code proposal, the fundamental masterpiece of European tort doctrine – Principles of European Tort Law as well as the Civil Code of Québec. In a successive way the paper analyses the sources of law on protection of personality, the definition of this law, an entitlements to sue and to be sued relating to protection of personality and the legal measures for such protection.
