Minor’s social rights protection in private law

Abstract:

Tato disertační práce se zabývá posouzením soukromoprávní oblasti ochrany sociálních práv nezletilých a v tendenčním výhledu charakteristikou sociálního mechanismu působení práva, zájmů jedinců a společnosti jakož i souvisejícími legislativními řešeními. Rovněž řeší výsledný stupeň sociální jistoty této věkové skupiny ve smyslu sociálních práv soukromoprávní povahy a hodnoty těchto práv jako nástrojů její sociální integrace. Nejvýznamnější pozornost v rámci zaměření této disertační práce je koncentrována na problémy vztahující se k pracovní činnosti mladistvých, kde je potřebné posoudit s jakou přesností je úprava sociálních práv formulována a s jakou mírou vylučuje nejistotu oprávněných subjektů v procesu jejich uskutečňování a je-li zárukou dostatečné prevence zneužívání práce a zároveň dostatečné flexibility nezletilých na trhu práce.

Abstract:

This dissertation deals with the assessment of the protection of social rights of minors in private law and in a tendentious prospect, by characteristics of the social mechanism of legal actions, interests of individuals and society, as well as the related legislative solutions. It also solves the resulting degree of social security in this age group in terms of social rights of a private nature and value of those rights as a tool of social integration. The most prominent attention in the focus of this dissertation is concentrated on the most substantial problems related to the occupational activities of the minors, where it is necessary to assess the accuracy, with which the legislation is formulated, and the extent to which it precludes uncertainty of the eligible subjects in the process of realization of the social rights, and the guarantee given by the legislation as regards ensuring sufficient prevention of abuse of work as well as sufficient flexibility of the minors on the labour market.
