Diplomová práce se zabývá jednou ze zvláštních povinností člena statutárního orgánu obchodní korporace, která je v úpadku. Žaloba na doplnění pasiv je novým incidenčním sporem ve smyslu insolvenčního zákona a slouží jako nástroj věřitelů proti členovi statutárního orgánu, který nesplnil své povinnosti. Diploma thesis deals with one of the special responsibilities of the executive of the business company in bankruptcy. Liability action for insufficiency of assets is new incidental dispute in terms of the Insolvency Act.
