Suspension of Activities and Dissolution of a Political Party in the Czech Republic

Abstract:

Diplomová práce se zabývá problematikou tzv. zákazů politických stran v České republice. Její součástí je ústavní a politologické vymezení pojmu politické strany, právní a politologická analýza možností a důvodů, pro které může stát do jejich činnosti zasahovat. Práce kromě současné české úpravy a aplikační praxe mapuje i aplikační praxi a právní úpravu československé první republiky jako státu, který byl nucen hájit svůj demokratický režim před vnitřními i vnějšími nepřáteli. Dále se zaměřuje na Německo vzhledem k tomu, že je pokládáno za modelový příklad konceptu „bojovné demokracie“, se kterým je spojen i požadavek na represi vůči nedemokratickým silám. A konečně práce vychází i z Evropské úmluvy a judikatury Evropského soudu pro lidská práva, kterou se české soudy stále častěji inspirují ve své rozhodovací činnosti a to nejen s ohledem na mezinárodní závazky, které České republice z Úmluvy plynou, ale i z důvodů její argumentační preciznosti. V rámci České republiky se práce zabývá institutem zákazu politické strany jak v současnosti, tak v období tzv. „první republiky“ (1918-1938). Největší pozornost je věnována nedávnému rozsudku českého Nejvyššího správního soudu ve věci vládního návrhu na rozpuštění Dělnické strany. Autor se staví kriticky zejména k požadavku na prokázání „dostatečné bezprostřednosti“ ohrožení demokracie (sufficiently imminent risk to democracy), jak se objevil v rozhodovací praxi Evropského soudu pro lidská práva i ve zmíněném rozsudku Nejvyššího správního soudu. V závěru autor rozlišil mezi právně a politicky definovanými kritérii pro rozhodování o důvodnosti zákazu politických stran. Ryze právní důvody pro zákaz politické strany vycházejí z abstraktně formulovaných kriterií, které mají dopadat na neomezený počet případů stejného druhu nehledě na to, jaké politické důsledky bude dané rozhodnutí mít. Naproti tomu politicky definované kriterium bude vždy vycházet z předpokládaného důsledku rozhodnutí v konkrétním případě. Politická forma odpovědnosti se totiž od právní liší v tom, že její jádro vždy spočívá v odpovědnosti za dosažený výsledek a nikoliv v odpovědnosti za dodržení abstraktně formulovaných norem. Ideální postoj k zákazu politických stran je třeba dle autorova názoru hledat mezi oběma nastíněnými přístupy. Při uplatnění těchto přístupů v krajních polohách hrozí paradoxně obdobné nebezpečí. V případě přílišného důrazu na abstraktní kritéria hrozí, že nebudeme schopni v abstraktní rovině vystihnout ta, která jsou pro zachování pluralitní demokracie nezbytné a zároveň ji příliš neomezí. V případě přílišného důrazu na individuální posouzení předpokládaného důsledku zákazu politické strany hrozí, že ani tento důsledek nebudeme schopni správně posoudit a rozhodnutí tak bude mít v konkrétním případě jiný důsledek, než jaký jsem schopni v danou chvíli předvídat. Bod, na kterém se oba tyto přístupy v praxi lámou, je zahrnutí posouzení dostatečnosti bezprostředního ohrožení demokracie stranou, která má být zakázána. Autor se domnívá, že vhodným kompromisem vzhledem k tomuto kritériu by bylo, pokud bude vnímáno pouze jako pomocné. Čili takové antidemokratické směřovaní politických stran, jehož nebezpečnost jsme zejména díky empirické zkušenosti s podobně orientovanými subjekty v minulosti schopni vystihnout už v zárodku, je třeba sankcionovat vždy nehledě na to, zda jsme schopni předvídat či dokázat bezprostřední ohrožení v konkrétním případě. tického směřovaní politických stran, když sankce za takové směřování bude hrozit vždy nehledě na dalších konkrétní okolnosti. Tam, kde bude ohrožení demokracie mlhavější a univerzální kritéria hůře aplikovatelná, zdá se být užitečné zasahovat až z titulu bezprostředně hrozícího nebezpečí, tak jak případně vyplyne ze všech okolností konkrétního případu.

Abstract:

The graduation thesis deals with the issue of so called prohibition of political parties in Czech Republic. The parts of it are determination of the concept of political party from the constitutional point of view, from the point of view of political science and the legal and political analysis of the opportunities and reasons for which the state can interfere in the activities thereof. Apart from the recent Czech regulations and the application practice, the thesis maps also the application practice and legal regulations of the Czechoslovak first republic as of the state which was forced to defend its democratic regime against the enemies within and outside. It is furthermore focused on Germany, being considered a model example of the “militant democracy” concept, which is also connected to the request for repression against nondemocratic forces. And finally the thesis also comes out from the European Treatment and from the jurisdiction of European Court for Human Rights, being more often the inspiration for Czech courts in their decision activity not only with regard to the international commitments, resulting from the Treatment for the Czech republic but also due to its argumentation accuracy. Within Czech Republic the thesis deals with the institute of political party prohibition both nowadays and in the area of so called “first republic” (1918-1938). The biggest attention is given to the recent judgement of the Supreme Administrative Court of the Czech Republic in the matter of the government proposal to dissolve Workers Party. The author assumes the critical attitude particularly to the request of proving the “sufficiently imminent risk to democracy” as it appeared in the decision practice of European Court for Human Rights and also in the Supreme Administrative Court judgement above mentioned. At the conclusion the author distinguished between the legal and political definition of the criteria for decision-making about political parties prohibition legitimacy. Purely legal reasons to prohibit a political party come out from the criteria abstractly formulated, which are to impact on the unlimited number of the identical cases not considering the political consequences of such a decision. Politically defined criterion will on the other hand always come out from the decision consequence anticipated in a specific case. Political form of responsibility is anyway different from the legal one as its core always lies in responsibility for the result achieved and not in responsibility for meeting the standards abstractly formulated. The ideal attitude to political parties’ prohibition should be in the author’s opinion looked for between the both approaches described. Using both these approaches in the extreme positions mean paradoxically the threat of the analogous danger. In case that too much emphasis is put on the abstract criteria there is a danger that we will not be able to perceive in the abstract level those criteria, which are essential for keeping the pluralist democracy and simultaneously not jeopardizing it. In case of the excessive stress on the individual assessment of a political party prohibition consequence anticipated there is a danger that we are not able to judge either such a consequence correctly and the decision in a specific case will thus have a different consequence from what we are able to anticipate in the certain moment. The break point of these two approaches in practice is the involvement of the appraisal of sufficiently imminent risk to democracy by a party to be prohibited. The author thinks that a suitable compromise with respect to this criterion would be to perceive such a criterion only as an auxiliary one. of the fact if we are able to anticipate or to prove the imminent risk in that specific case. In that way we will both eliminate the danger that we underestimate the immediacy of risk to democracy in the specific case and we will simultaneously increase motivation to abandon the undemocratic orientation of political parties when the sanctions for such orientation will always impend without regards to other concrete circumstances. Where the risk to democracy will be indefinite and application of the universal criterions will be more difficult, it seems to be useful to interfere only by virtue of the imminent risk as it will be possibly followed from all the circumstances of the specific case.
