Abstract:

Předložená bakalářská práce nás zavádí do problematiky nového alternativního trestu domácího vězení, který nabyl účinnosti 1. ledna 2010 po novelizaci zákona č. 40/2009 Sb., trestní zákoník, který nahradil stávající zákon č. 140/1961 Sb., trestní zákon. Alternativní tresty umožňují potrestání odsouzeného, aniž by byl uložen trest odnětí svobody. Odsouzený je nadále na svobodě, ale jsou mu uložena určitá omezení a povinnosti. Nemůže například navštěvovat určitá místa, vykonávat různé činnosti. Výkon trestu je zde nahrazen formou výkonu domácího vězení nebo formou obecně prospěšných prací. Velmi důležitým aspektem alternativního trestu je skutečnost, že u odsouzeného nedochází k zpřetrhání sociálních vazeb což je z penitenciárního pohledu velice důležitý aspekt. Odsouzenému jsou uloženy podmínky k výkonu trestu domácího vězení, které musí bezpodmínečně dodržovat. Cílem této práce je zjistit jaké dopady má alternativní trest na osobnost odsouzeného a jeho sociální vazby a zda se uložením alternativního trestu snižuje riziko recidivy.

Abstract:

The present thesis introduces us to the issue of a new alternative sentence of house arrest, which came into effect on 1 January 2010 following the amendment of Act No. 40/2009 Coll., Penal Code, which replaced the existing Law No. 140/1961 Coll. criminal law. Alternative sentences allow for the punishment of the convict, without a custodial sentence. The prisoner is still at large, but they are imposed certain restrictions and obligations. For example, can not attend certain places, perform different activities. The performance penalty is replaced by power house arrest or in the form of community service. A very important aspect of the alternative punishment is the fact that the prisoner does not severed social bonds which are from the perspective penitenciálního very important aspect. Conditions are imposed on a convicted person sentenced to house arrest, which must be observed. The aim of this study is to determine what impact the alternative sentence on the convict's personality and his social ties and that the imposition of alternative sentences reduces the risk of recurrence.
