Abstract:

Cílem této diplomové práce je charakterizovat vývoj a současnou situaci v oblasti mezinárodní ochrany menšin a na příkladě České a Slovenské republiky poukázat na skutečnost, že pouze snaha států o řešení dané problematiky nestačí. Je nezbytná vzájemná kooperace a spolupráce. Teprve pak můžou být veškeré legislativní normy aplikovány úspěšně. Na problematiku nahlížím z pohledu mezinárodních organizací, jakými jsou Organizace spojených národů, Organizace bezpečnosti a spolupráce v Evropě a Rada Evropy, tak z pohledu již zmíněné Česká a Slovenské republiky, které ratifikovaly většinu zde zmíněných dokumentů. Práci jsem zaměřila nejdříve na teoretická východiska a definice dané problematiky a postupně poukazuji na implementaci jednotlivých mezinárodních dokumentů a jejich kontrolních mechanismů na mezinárodní úrovni. V případě České a Slovenské republiky jsem se zaměřila na implementaci jedné z nejdůležitějších úmluv o ochraně menšin v těchto státech.

Abstract:

The main objective of my Diploma paper is to describe the development and the current situation on the field of International Protection of Minorities. Using the example of the Czech and Slovak republic, I would like to point out the fact that only the endeavour to solve this issue is not enough. The mutual cooperation and collaboration is essential. When this is clear, all the other legislative standards can successfully be applied. I see the dilemmas from the various international organizations point of view, such as United Nations Organization, Organisation of security and cooperation in Europe, the Council of Europe and also from the point of view of the Czech and Slovak republic. These two states have already ratified the majority of herein mentioned documents. My diploma work focuses first on the theoretical solution and definitions of the existing dilemmas and gradually points out at the implementation of particular international documents and their supervisory mechanisms on the international level. In case of the Czech and Slovak republic I focused on the implementation of one the most important agreement about the protection of minorities in these states.
