Citizenship of the Czech Republic and the citizenship of the European Union

Abstract:

Cílem diplomové práce je analyzovat občanství ČR a EU a provést jejich srovnání. Práce je rozdělena do pěti částí, úvodu a závěru. Prvá kapitola analyzuje občanství z teoretického hlediska. Nejprve popisuje historický vývoj občanství, poté analyzuje typická práva a povinnosti občanů, způsoby nabývání a pozbývání státního občanství. Druhá kapitola analyzuje občanství ČR. Po stručném úvodu do historického vývoje se zaměřuje na současnou právní úpravu, založenou na principu ius sanguinis. Následující kapitola analyzuje občanství EU. Z charakteru evropské integrace, jakož i z práv a povinností občanstů EU může být odvozena charakteristika občanství EU, jež se vyznačuje derivativností, obsahem vymezeným kompetencemi EU, zprostředkovaností, subsidiaritou, spojením s integračním stupněm, zákazem dotčení principem flexibility, mezistátním prvkem, předností. Ve čtvrté kapitole práce vymezuje, zda je občanství EU občanstvím v materiálním smyslu. Je diskutován koncept úzkého vztahu mezi občanem a státem, zejména teorie no demos. EU je integračním uskupením sui generis, mnoho z jeho rysů jsou původní a není možné je kategorizovat. Pravděpodobně byl vytvořen nový institut zasluhující samostatnou kategorii. Poslední kapitola analyzuje fungování občanství v ČR a porovnává jej s občanstvím EU (politická práva, svoboda pobytu a pohybu, zákaz diskriminace). Občanství EU představuje širokou problematiku, která zasluhuje hlubší výzkum. Zajímavým tématem je fungování mezistátního prvku a možná obrácená diskriminace, jakož i vliv občanství na právní řády jednotlivých členských států.

Abstract:

Aim of this diploma thesis is to analyze citizenship of the Czech Republic and citizenship of the European Union and carry out their comparison. The thesis is divided into five parts, introduction and conclusion. First chapter analyses citizenship from theoretical point of view. Firstly, historical development of the concept of citizenship is described. Then, the thesis defines citizenship and analysis typical rights and duties of citizens, ways of acquirement and loss of citizenship. Second chapter analyzes citizenship of the Czech Republic. After brief introduction into development of citizenship in Czech lands, main part of the chapter focuses on recent legal adoption, based on ius sanguinis principle. Following chapter analyzes citizenship of the EU. From the character of European integration as well as from the rights and duties of EU citizens can be derived characteristics of EU citizenship, i.e. derivativeness, content of the citizenship is limited by EU competences, mediateness, subsidiarity, connection to integration stage, inviolateness by flexibility principle , interstate element, supremacy. In the third chapter, the Thesis analyses if EU citizenship may be considered as nationality in the material sense. The concept of relation between citizens and state is being discussed, namely the no demos theory. EU is a sui generis integration, many of its features are original and it is not possible to categorize them. Possibly, a new institute was created capable of creating a separate category. Last part of the thesis focuses on functioning of EU citizenship in the Czech Republic and compares citizenship of the Czech Republic with EU citizenship (political rights, right to reside freely, prohibition of discrimination). EU citizenship represents a large problematic that deserves further research. An interesting topic is functioning of interstate element and possible reverse discrimination, as well as influence of EU citizenship on member states legal orders.
