Discharge from Debts under the Act of Bankruptcy

Abstract:

Rigorózní práce na téma Oddlužení dle insolvenčního zákona pojednává o oddlužení jako způsobu řešení úpadku dle zákona č. 182/2006 Sb., o úpadku a způsobech jeho řešení (insolvenční zákon). Insolvenční zákon zavedl do našeho právního řádu zcela nové způsoby řešení úpadku, a to reorganizaci a oddlužení. Oddlužení lze provést zpeněžením majetkové podstaty nebo plněním splátkového kalendáře. Oddlužení představuje možnost pro osoby, které nejsou schopny splácet své splatné závazky, řešit své dluhy jiným způsobem, než formou likvidačního konkursu. V myšlence oddlužení tak převážil sociální přístup nad přístupem ekonomickým. Tento tzv. spotřebitelský úpadek či osobní bankrot popírá podstatu konkursu, sjednocuje dlužníkovi dluhy a umožňuje dlužníku být za splnění jistých podmínek osvobozen od části jeho dluhů, což dosud bylo zcela nemožné. Oddlužení však není přípustné u všech dlužníků obecně. Oddlužení se může týkat nepodnikatelů (fyzických i právnických osob). Použití oddlužení má být tedy praktické zejména u dlužníků - fyzických osob, kteří mají pravidelný příjem, z něhož mohou hradit pravidelné splátky svých dluhů.

Abstract:

The doctoral thesis with the theme Discharge from Debt under Insolvency Act deals with the discharge from debt as a manner of bankruptcy resolution under Act No. 182/2006 Coll. on Bankruptcy and its Resolution (Insolvency Act). The Insolvency Act introduced completely new manners of bankruptcy resolution, i.e. restructuring and discharge from debt. The discharge from debt may be implemented by liquidation of assets or by repayment according to a repayment schedule. The discharge from debt is an option for persons, who are unable to repay their mature liabilities and to repay their debts in any other way than by liquidation bankruptcy. Thus, social approach prevails over economic aspects in the idea of the discharge from debt. This so-called consumer insolvency or personal bankruptcy denies the essence of bankruptcy; it unites debtor’s liabilities and enables the debtor to be relieved from part of his debt provided that certain conditions are met, a manner of resolution that has been impossible so far. However, the discharge from debt does not generally apply to all debtors. It may apply to persons who are not entrepreneurs (both natural and legal persons). Thus the institution of the discharge from debt is practically applicable mainly for natural persons who have a regular income which can be used for regular repayments of the debt.
