Legal regulation of possession and carrying of weapons from 1918 to the present

Abstract:

Tato diplomová práce se zabývá právní úpravou držení a nošení zbraní od roku 1918 až po současnost spolu s její aplikací v praxi. Kapitola první je orientovaná na vymezení a vysvětlení základních pojmů a jejich základní charakteristiku.V kapitole druhé je obsažen císařský patent z roku 1852. Historický vývoj právních úprav nošení a držení zbraní v meziválečném je zařazen do třetí kapitoly. Kapitola čtvrtá je zaměřena na období druhé světové války a s tím spojené období Protektorátu Čechy a Morava. Obsahem této kapitoly jsou nařízení, která ovlivnila právní úpravu držení a nošení zbraní v tomto období. Navazující kapitola pojednává o právní úpravě držení a nošení zbraní v období komunismu. V poslední kapitole, která pojednává o období po rozpadu ČSSR, je částečný odklon od historie a je zde rozebrána aktuální právní úpravu držení a nošení zbraní, včetně některých nařízení Evropské unie, které zasahují do aktuální úpravy českého vnitrostátního práva.

Abstract:

This thesis deals with the legal regulation of the possession and carrying of weapons from 1918 to the present day, together with its application in practice. Chapter One is oriented towards the definition and explanation of the basic concepts and their basic characteristics.Chapter Two covers the Imperial Patent of 1852. The historical development of the legal regulation of the carrying and possession of arms in the interwar period is included in chapter three. Chapter four focuses on the period of the Second World War and the associated period of the Protectorate of Bohemia and Moravia. The content of this chapter covers the regulations that influenced the legal regulation of the possession and carrying of weapons during this period. The following chapter deals with the legal regulation of the possession and carrying of weapons during the communist period. The last chapter, which deals with the period after the collapse of the Czechoslovak Socialist Republic, is a partial departure from history and discusses the current legislation on the possession and carrying of weapons, including some of the European Union regulations that interfere with the current Czech national legislation.
