Criminal Act Public Menace Commited at Concerning Road Traffic

Abstract:

V této práci se zabývám trestným činem obecné ohrožení spáchaném při provozu na pozemních komunikacích, a to konkrétně v souvislosti s porušením ustanovení § 28 a § 29 ZPPK. V první části budou rozebrány obligatorní znaky této skutkové podstaty a vymezení hranice mezi trestným činem a přestupkem. Druhá část se zaměřuje zejména na pachatele této trestné činnosti a jejich vlivem na jeho spáchání. Nebude opomenuta ani problematika dokazování, otázky prevence včetně vlastních úvah de lege ferenda.

Abstract:

The focus of this thesis is a criminal offence of public menace commited at concerining traffic roads, specifically breach of section 28 and section 29 of the Act No. 361/2000 Sb. concerning road traffic. The first part of this thesis is focused on mandatory signs of the crime and differences between criminal offence and a misdemeanour. The second part is focused on offenders and their influence on consequences. Problematic of evidence and questions of prevention will be adressed, as well as my own suggestions for de lege ferenda.
