Privacy and Data Protection in the Workplace

Abstract:

Tato diplomová práce se věnuje tématu ochrany osobních údajů a soukromí na pracovišti, konkrétně specifikům ochrany soukromí a ochrany osobních údajů ve vztahu mezi zaměstnancem a zaměstnavatelem. Obecná část této práce je zaměřena na otázku vzájemného postavení práva na soukromí a práva na ochranu osobních údajů a na analýzu specifik těchto práv plynoucí z právně slabšího postavení zaměstnance. Zvláštní část práce je věnována monitoringu zaměstnanců na pracovišti i mimo něj prostřednictvím kamerových systémů, GPS technologií, prostřednictvím kontroly e-mailových schránek zaměstnance, kontroly činnosti zaměstnance na internetu a kontroly telefonních hovorů zaměstnance. V této práci jsou zjištěny a popsány podmínky zavedení zmíněných systémů monitoringu zaměstnanců s přihlédnutím k relevantním ustanovením GDPR a zákoníku práce a k aktuální judikatuře soudů.

Abstract:

This diploma thesis is dedicated to the topic of privacy and data protection in the workplace, especially the specifics of privacy and personal data protection in the relationship between employee and employer. The general part of this diploma thesis is focused on the issue of the reciprocal position of the right to privacy and the right to personal data protection and the analysis of the specifics of these rights resulting from the legally weaker position of the employee. The special part of this diploma thesis is devoted to monitoring of employees at the workplace and outside it through camera systems, GPS technology, through the control of employee e-mail boxes, online activities and employee phone calls. In this diploma thesis, the conditions for the introduction of the mentioned systems of employee monitoring are identified and described, taking into account the relevant provisions of the GDPR and the Labor Code and the current case law of the courts.
