Abstract:

Bakalářská práce na téma Nakládání s majetkem územních samosprávných celků se zabývá pouze některými okruhy dané problematiky. Práce je rozdělena do čtyř částí. V první části jsou vymezeny související pojmy, vlastnické právo, ústavní a zákonné postavení územních samosprávných celků jako subjektů vlastnického práva. V druhé části je představen majetek územní samosprávy a přístupy k jeho třídění. Širší pozornost je věnována zásadám při hospodaření s tímto majetkem. Na ni navazuje část třetí, která popisuje přímý a zprostředkovaný výkon vlastnického práva a jiných majetkových práv. Vedle přímého výkonu, který obce (kraje) uskutečňují svými orgány, je detailněji rozveden výkon zprostředkovaný - zabezpečovaný organizačními složkami, příspěvkovými organizacemi a svazky obcí. Čtvrtá část práce se zabývá způsoby nakládání s majetkem, jednotlivými orgány územních samosprávných celků, jejich pravomocemi a vzájemnými vztahy při majetkoprávním jednání. Pro ucelenost práce jsou uvedeny procesní postupy, které zákon spojuje s nakládáním majetku obcí a krajů. V závěru práce je provedeno shrnutí a nastíněny možnosti změn právní úpravy.

Abstract:

The bachelor´s thesis on Management of the Local Government Units Assets deals with some areas of the topic. The thesis is divided into four parts. The first part defines related terms, the property law and the constitutional and statutory position of the local governments as the entities of the property law. The second part presents the assets of the municipal authorities and the attitudes to its classification. Wider attention is paid to the principles in the management of this property. The third part describes the direct and mediated administration of the property law and other proprietary rights. In addition to the direct performance which the municipalities (regional authorities) execute through their authorities, the mediated administration is specified in detail - it is ensured by the assurance departments, state-funded institutions and the associations of municipalities. The fourth part deals with the treatment of assets, with the different bodies of the local government units, their powers and their mutual relations in the property-negotiations. To make the thesis complete there are procedural processes stated, which the law relates to the management of the municipalities and the counties. In conclusion there is a summary made and there are outlined the possible modifications in the legislation.
