Donation Contract

Abstract:

Cílem této práce je komplexní charakteristika darovací smlouvy dle právní úpravy obsažené v zákoně č. 89/2012 Sb., občanský zákoník. Východiskem pro její zpracování je zachycení historického vývoje a širšího sociologicko-kulturního, právního a ekonomického aspektu darovací smlouvy. Práce se zabývá taktéž odlišením darovací smlouvy od smlouvy kupní, jako dvou nejčastějších smluv, na jejichž základě dochází k převodu vlastnického práva. Stěžejní část práce pak představuje podrobné rozebrání darovací smlouvy jako pojmenované asynallagmatické smlouvy, a to s nejrůznějšími jejími modalitami, které současná právní úprava obsažená v občanském zákoníku nabízí. V závěru práce je také nastíněna dílčí komparace darovací smlouvy s právní úpravou v Nizozemsku. Při vypracování diplomové práce byla použita především metoda genetická, systémová strukturní analýza a systémová srovnávací analýza. Jako primární zdroj informací byly použity odborné publikace, články a právní předpisy, avšak autorka čerpala taktéž z judikatury českých soudů. Výsledkem této práce by měl být výstižný a podrobný právní rozbor darovací smlouvy, jenž zohledňuje taktéž její historické kořeny a mimoprávní aspekty.

Abstract:

This thesis aims to provide a complex characteristic of a donation agreement as defined in the Civil Code (no. 89/2012). Description of the historical development and wider sociocultural, legal and economic aspects of the donation agreement stipulate the basis of the work. The thesis is also helping to clearly distinguish between donation agreement and sale contract as two most common contract types where transfer of ownership occurs. Main part of the thesis provides a detailed analysis of a donation agreement as a specific unilateral contract, including all available modalities that the current civil law measures allow for. The last section of the thesis provides a comparison with a donation agreement in the Netherlands. Genetic method, structured system analysis and systematic comparative analysis are the main methods used when creating this thesis. Primary information sources for this thesis were professional publications, articles and legislation. However, the author also researched the case law of Czech courts. The outcome shall be a concise and detailed legal analysis of a donation agreement that also reflects its historical roots and non-legal aspects.
