Abstract:

Bakalářská práce na téma Postup orgánů činných v trestním řízení před zahájením trestního stíhání pojednává o postupu policejního orgánu, státního zástupce a soudu v první fázi přípravného řízení, tedy na úplném začátku celého trestního řízení. V úvodní kapitole práce je stručně popsáno trestní řízení jako celek, na což navazuje kapitola o bližší charakteristice přípravného řízení, jeho rozdělení do dvou částí, vztahu k hlavnímu líčení a o třech formách tohoto stádia. Orgány činné v trestním řízení, resp. orgány přípravného řízení, tedy policejní orgán, státní zástupce a soud, jsou popsány v kapitole 4. Následující kapitola pojednává již konkrétně o postupu těchto orgánů před zahájením trestního stíhání. Je zde vymezena charakteristika tohoto postupu, popsána oprávnění orgánů včetně operativně pátracích prostředků, stručně vysvětleny neodkladné a neopakovatelné úkony a uvedeny možnosti skončení této fáze trestního řízení. V závěrečné kapitole se pak práce zabývá zkráceným přípravným řízení jako zvláštním typem přípravného řízení a jeho skončením.

Abstract:

This bachelor paper Procedure of Bodies Active in Criminal Proceedings before the Criminal Prosecution describes the procedures followed by the police authorities, the public prosecutor and the law court in the first part of the preparatory proceedings, which means at the very beginning of the whole criminal proceedings. The first chapter deals with the criminal proceedings as a whole and this chapter is followed by a more detailed description of the general characterstics of the preparatory proceedings. This is divided into two parts and its relationship to the court hearing is also depicted. The authorities involved in the criminal proceedings, to be more precise the authorities involved in the preparatory proceedings, i.e. the police authorities, the public prosecutor and the law court are described in chapter 4. The next chapter focuses on the exact procedure of the above mentioned authorities before initiating the criminal prosecution. The overall characteristics of this procedure are specified as well as the legal powers of the involved authorities including the investigation methods. Further on, urgent and on-the-spot procedures are explained and the possibilities of concluding this part of the criminal proceedings are specified. The final chapter deals with the reduced preparatory proceedings which represents a special type of preparatory proceedings and this chapter also describes how it is concluded.
