The Court Interpreters’ Role and the Predicaments They Might Face

Abstract:

Tato diplomová práce se zabývá tématem soudního tlumočení a především dvěma hlavními oblastmi, které s ním souvisí – zejména je to role soudních tlumočníků a problémy, s kterými se mohou v soudní síni setkat. Cílem této práce je představit výzkum provedený na toto téma a následně jej porovnat s názory českých a slovenských soudních tlumočníků, kteří tlumočí z a do angličtiny. Práce představuje tlumočení z teoretického hlediska a zmiňuje se o právu na tlumočení u soudu. Také pojednává o současné situaci soudních tlumočníků ve Velké Británii, jelikož mnoho českých a slovenských soudních tlumočníků pracuje právě tam. V práci je představeno několik mezinárodních i místních organizací, které zastupují zájmy soudních tlumočníků. Poté jsou uvedeny statistické informace z českého a slovenského Ministerstva spravedlnosti, které se týkají počtu tlumočníků a soudních řízení, u kterých tlumočí. Dále bylo zjištěno, že podle vědeckých studií je jedinou doporučenou rolí pro soudního tlumočníka takový tlumočník, který věrně reprodukuje promluvy druhých. Kromě toho se práce zabývá lingvistickými, procedurálními a etickými problémy, se kterými se soudní tlumočník musí vypořádat. Dále jsou analyzovány údaje získané z dotazníku a testují se hypotézy autorky. Je prokázáno, že navzdory nedávné změně ve vnímání soudního tlumočníka spíše jako aktivního účastníka přelíčení, který má vliv na soudní řízení a jeho potenciální výsledek, čeští a slovenští soudní tlumočníci se stále vnímají jako pasivní „překládací stroje“. Role, které si tito tlumočníci připisují, ne vždy odpovídají vědeckým studiím. Jako nejzávažnější problémy soudního tlumočníka se dle průzkumu jeví otázky procedurální a nikoli otázky lingvistické nebo etické. Na závěr práce jsou navrženy oblasti vhodné pro další úvahy a výzkum.

Abstract:

This diploma thesis deals with the topic of court interpreting and specifically, with the two major areas related to it – namely the role of court interpreters and the predicaments they may come across in the courtroom. The aim of the thesis is to introduce the research done on this topic and subsequently, to compare it with the views of Czech and Slovak court interpreters with English as a working language. Interpreting as a field of study is introduced from the theoretical point of view, the law concerning the right to interpretation at court is dealt with, and the current situation of court interpreters in Great Britain is mentioned, as a number of Czech and Slovak court interpreters work there. Numerous global and local institutions representing court interpreters’ interests are mentioned. Then, statistical information from the Czech and Slovak Ministry of Justice is provided, as far as the numbers of interpreters and court proceedings assisted by them are concerned. Furthermore, it is found out that according to scholarly studies, the role of a faithful renderer of utterances is the only one recommended. Moreover, the linguistic, procedural and ethical predicaments a court interpreter might have to deal with are discussed. Consequently, the data obtained from the questionnaire are analysed and the author’s hypotheses are tested. It is proven that despite the recent shift towards perceiving a court interpreter as an active participant of the courtroom interaction who influences the proceedings and potentially their outcome, the Czech and Slovak court interpreters still view themselves as passive “translation machines”. Then, the roles they adopt do not always correspond to scholarly studies; the most serious issues for a court interpreter, the survey has shown, are the procedural ones as opposed to linguistic and ethical. Finally, areas for further considerations and research are proposed.
