Childcare after divorce or separation of parents

Abstract:

Bakalářská práce je teoretického charakteru a zabývá se formami péče o dítě po rozvodu nebo rozchodu rodičů. Práce je členěna do čtyř hlavních kapitol. První kapitola je zaměřena na rodinu, její funkce a důležitost pro dítě, vymezuje pojmy rozvodu, rozchodu, manželství, nesezdaného soužití a rodičovských práv a povinností. Druhá kapitola se orientuje na formy péče o dítě, jako je výlučná, společná či střídavá. V této souvislosti rozebírá také syndrom zavrženého rodiče, participaci dítěte a rodičovský plán. Třetí kapitola popisuje systém odborné pomoci v této oblasti, jako např. kolizní opatrovnictví, asistované kontakty, rodinná mediace, a také roli advokátů, soudu, soudního znalce či terapeutů a poraden. Poslední kapitola se věnuje analýze statistických dat rozvodovosti a porozvodové péče o dítě v letech 1998-2021 a výzkumu zaměřeného na střídavou péči.

Abstract:

This bachelor thesis is theoretical and deals with the forms of childcare after divorce or separation of parents. The thesis is divided into four main chapters. The first chapter is focused on family, its functions and importance for the child, defines the concepts of divorce, separation, marriage, non-marital cohabitation and parental rights and responsibilities. The second chapter deals with forms of childcare, such as sole, joint, or shared. In this context, it also focuses on the parental alienation syndrome, child participation and the parenting plan. The third chapter describes the system of professional assistance in this area, such as collision guardianship, assisted contact and family mediation, as well as the role of lawyers, the court, the forensic expert or therapists and counselling. The last chapter is devoted to the analysis of statistical data on the divorce rate and post-divorce childcare in the years 1998-2021 and research focused on shared custody.
