The Highest Building Authority from the Point of View of Public Administration Organization

Abstract:

Vznik Nejvyššího stavebního úřadu představuje významnou reformu výkonu státní správy za poslední roky. S Nejvyšším stavebním úřadem počítá zákon č. 283/2021 Sb., stavební zákon, který nahrazuje dosavadní nejstěžejnější stavební předpis – zákon č. 183/2006 Sb., o územním plánování a stavebním řádu (stavební zákon), ve znění pozdějších předpisů. V novém pojetí státní stavební správy největší část pravomocí přechází na Nejvyšší stavební úřad a jemu podřízené úřady. Těmi jsou Speciální a odvolací stavební úřad a krajské stavební úřady. Ke zřízení Nejvyššího stavebního úřadu a jemu podřízených úřadů došlo ke dni 1. 1. 2022, neboť ta část zákona č. 283/2021 Sb., stavební zákon, upravující novou soustavu orgánů ve státní stavební správě, nabyla účinnosti právě k tomuto dni. Prozatím lze však hovořit pouze o formálním vzniku těchto nových úřadů, neboť ustanovení zákona č. 283/2021 Sb., stavební zákon, která upravují jejich pravomoci, mají (prozatím) nabýt účinnosti až dne 1. 7. 2023. Stěžejním motivem této práce je právě Nejvyšší stavební úřad, a jak napovídá název této bakalářské práce, především Nejvyšší stavební úřad z pohledu organizace veřejné správy. Bakalářská práce je rozdělena do 4 částí. V první z nich se autor stručně vyrovnává s pojmem veřejné správy a s jejím dělením. Takové vymezení je zejména zapotřebí k určení, jakou část veřejné správy Nejvyšší stavební úřad a jemu podřízené úřady budou vykonávat, a kdo je konkrétně nositelem veřejné správy. Samotná organizace Nejvyššího stavebního úřadu a jemu podřízených úřadů je zkoumána ve světle principů organizace veřejné sprá-vy. Proto i tato bakalářská práce poskytuje úvodní vymezení jednotlivých principů, které se při organizaci veřejné správy projevují. Autor práce popisuje principy centralizace a decentralizace, koncentrace a dekoncentrace, princip delegace, monokratický a kolegiální princip, princip věcné specializace, teritoriální princip, princip jmenovací a vo-lební s akcentem na princip výběrového řízení a princip profesionální a laický. Část této bakalářské práce je věnována i současné stavební správě. Je zkoumáno, které konkrétní orgány veřejné správy vykonávají činnosti ve stavební správě, tj. na úseku územního plánování a na úseku stavebního řádu. Zde se autor věnuje zejména roli ústředních orgánů státní správy ve státní stavební správě, ale především orgánům územních samosprávných celků, tedy zastupitelstvu kraje, zastupitelstvu obce, radě kraje, radě obce, krajskému úřadu a obecnímu úřadu. Zájmu práce neunikají úkoly, které jsou těmto orgánům za současného stavu svěřeny, ale ani principy organizace veřejné správy, na základě kterých tyto orgány v současné státní stavební správě fungují. Nejpodstatnější část práce poté zkoumá novou státní stavební správu, v jejímž čele stojí Nejvyšší stavební úřad. Toto zkoumání probíhá na základě metody komparace, zejména se současnou státní stavební správou. Dále je nová soustava orgánů statní stavební správy podrobena analýze její organizace, a to z hlediska principů organizace veřejné správy, které se při jejím ustavování projevily. Kromě toho autor práce nastiňuje, jaké nové úkoly budou jednotlivým orgánům státní stavební správy v budoucnu svěřeny. Tato bakalářská práce tak představuje vhled do nové soustavy orgánů státní stavební správy, její organizace a fungování, v porovnání s organizací současné státní stavební správy, s akcentem na principy organizace veřejné správy, které můžeme při vzniku nové soustavy orgánů státní stavební správy sledo

Abstract:

The establishment of the Highest Building Authority represents a sig-nificant reform of the state administration in recent years. Act No. 283/2021 Coll., the Building Act, which replaces the most central building regulation to date - Act No. 183/2006 Coll., on Spatial Planning and Building Code (Building Act), as amended, provides for the Highest Building Authority. In the new concept of the state building administration, most of the powers are transferred to the Highest Building Authority and its subordinate authorities. These are the Special and Appellate Building Authority and regional building authorities. The establishment of the Highest Building Authority and its subordinate authorities took place on 1 January 2022, as the part of Act No 283/2021 Coll., the Building Act, regulating the new set of authorities in the state building administration, came into force on that date. For the time being, however, we can only speak of the formal establishment of these new authorities, since the provisions of Act No 283/2021 Coll., the Building Act, which regulate their powers, are (for the time being) not due to come into force until 1 July 2023. The central theme of this thesis is the Highest Building Authority, and as the title of this bachelor thesis suggests, especially the Highest Building Authority from the perspective of the organization of public administration. The bachelor thesis is divided into 4 parts. In the first one, the author briefly deals with the concept of public administration and its division. Such a definition is especially necessary to determine what part of public administration the Highest Building Authority and its subordinate authorities will perform, and who specifically is the carrier of public administration. The actual organization of the Highest Building Authority and its subordinate authorities is examined in the light of the principles of the organization of public administration. Therefore, this bachelor thesis also provides an initial definition of the various principles that are manifested in the organization of public administration. The author of the thesis describes the principles of centralization and decentralization, concentration and deconcentration, the principle of delegation, the monocratic and collegial principles, the principle of subject specialization, the territorial principle, the principle of appointment and elec-tion with emphasis on the principle of selection, and the principle of professional and lay. Part of this bachelor thesis is also devoted to contemporary building administration. It is examined which specific public administration bodies carry out activities in the building administration, i.e. in the field of spatial planning and in the field of building code. Here, the author focuses on the role of the central state administration bodies in the state building administration, but mainly on the bodies of local self-government units, i.e. the regional council, the municipal council, the regional authority and the municipal authority. The work does not miss the tasks that are entrusted to these bodies under the current state of affairs, but also the principles of the organization of public administration on the basis of which these bodies function in the current state building administration. The most important part of the work then examines the new state building administration, headed by the Highest Building Authority. This examination is based on the method of comparison, in particular with the current state building administration. Next, the new system of bodies of the State Building Administration is analysed in terms of its organization and the principles of the organization of public administration that have been reflected in its establishment. In addition, the au-thor of the thesis outlines what new tasks will be entrusted to the individual bodies of the state building administration in the future.
