Abstract:

RESUME: Ve své práci na téma Správa místních poplatk v praxi obecních úad jsem se pokusil piblížit místní poplatky z pohledu správce tchto poplatk, kdy každá z obcí na území eské republiky, má ve správ alespo jeden i více místních poplatk. Problematika místních poplatk se ovšem nedotýká jen všech obcí v eské republice jako územních spoleenství oban, které je stanovují a pro nž tyto pedstavují jeden z nezanedbatelných daových píjm, ale ve skutenosti také všech osob, nebo každý z nás, a již jako bžná osoba i jako podnikatelský subjekt, je poplatníkem alespo nkterého zákonem zakotvených místních poplatk. V úvodu bylo mou snahou charakterizovat význam místních poplatk pro obce z pohledu možnosti zisku finanních prostedk plynoucích do obecních rozpotu. Místní poplatky mají však vedle funkce fiskální, což znamená, že smyslem tchto poplatk je zajištní uritých píjm do rozpotu obce, také funkci regulaní i ochrannou, která vyplývá z výše popisované urité míry volnosti v rozhodování obcí, obec vlastn zavedením i nezavedením uritého poplatku, stanovením urité výše konkrétního druhu poplatku, prost celkov zvolenou skladbou a podobou místních poplatk vybíraných ve svém obvodu do jisté míry mže ovlivnit frekvenci uritých inností na svém území, obecnji poádek obce, istotu obce. Místní poplatky jako píjmy obecních rozpot slouží zejména k realizaci obecních a veejných poteb, a to vždy v souladu s rozhodnutím zastupitelstva obce, kterému je schvalování rozpotu obce vyhrazeno. Dále ve své práci popisuji jakým zpsobem ( zákonným postupem) mohou obce na svém území zavést konkrétní místní poplatek. Zákonné zmocnní k tomu, aby obce rozhodovaly o tom, zda pro své území zavedou jednotlivé místní poplatky vychází ze samotného znní zákona o místních poplatcích. Pokud se obce rozhodnou zavést místní poplatky, uiní tak vlastní obecn závaznou vyhláškou, kdy mimo jiné v zákonem urených limitech stanoví jejich výši i podmínky jejich vybírání, zejména jejich konkrétní sazbu, ohlašovací povinnost ke vzniku a zániku poplatkové povinnosti, splatnost, i naopak úlevy a osvobození od nich. Výtem jednotlivých druh místních poplatk a jejich následným popisem pecházím ke konkrétní innosti správce místního poplatku, myšleno jako etapu správy již obecn závaznou vyhláškou stanoveného místního poplatku. V této poslední ásti jsou rozlišeny dva pohledy správce místního poplatku na správu jednotlivých místních poplatk. V prvém pípad se jedná o innost vesms evidenní a úetní, to v pípad, kdy poplatník se k místnímu poplatku pihlásí /splní ohlašovací povinnost/ a následn v termínu splatností poplatku odvede tento v pedepsané výši na úet správce místního poplatku. V pípad nesplnní poplatkové povinnosti, tj. v pípad, že místní poplatek nebude vas a ve stanovené výši uhrazen, se již jedná o správní innost jejímž cílem bude vymení a vymožení tohoto neuhrazeného místního poplatku.

Abstract:

RESUME: In my thesis dealing with the topic of "Local Fees Administration in the operation of Municipal Offices I have tried to describe local fees as they are viewed by a local fees administrator, taking in account that each municipality on the territory of the Czech Republic administers at least one or more local administrative fees. The issue of local fees does not concern only Czech municipalities, being terrestrial communities of citizens who set these fees, and for whom these fees represent a significant portion of income, but it actually concerns all of us, since each of us is either a personal entity or a tax unit, we all have to pay at least some of these imposed local fees. In the introduction, I have tried to characterize the significance of local fees for municipalities with regards to possible gain of financial resources flowing into municipal budgets. But what is more, local fees also have other functions, besides the fiscal one which means that these fees is to get certain income to a municipality budget they also have a regulatory or protective function, which results from the above mentioned level of independence in municipality decision making. By introducing or not introducing a certain fee, by setting the amount of a certain fee, simply by the whole composition and the whole system of collecting local fees, a municipality unit can actually to certain level influence the frequency of certain activities on its territory, more generally then municipality public order, municipality cleanliness. Local fees as incomes to municipal budgets serve especially for realizing municipal and public needs, which is always performed in accordance with the board of representatives resolutions which is authorized to approve a municipality budget. Further in my thesis I have written about the way (a legal instrument) municipalities can introduce a certain local fee. Legal authorization for municipalities to decide whether they set certain local fees for their teritorry comes out from the Act on Local Fees itself., If municipalities do decide on introducing local fees, they do so by means of their own obligatory ordinance where among others they will set the amount of the fees within the range given by law, as well as the way of collecting these fees, and conditions of collecting them, especially their specific charges, duty of registration on rise and cease of the fee duty, dates due, or allowances and exceptions from the duty. By listing the individual kinds of local fees and their further description I have entered the field of the actual work of a local fees administrator, considered as administrative work given by the obligatory ordinance on the local fee. In this last chapter there are two views of a local fees administrator on administering individual local fees. In the first case the work involves registering and accounting activities, this is the case when a ratepayer fulfills his duty and registers for paying, and consequently by the due date pays this specific fee in its specific amount to the local fees administrators account. In case of not fulfilling the fee duty, that is the case when the fee is not paid on time and in its given amount, the work involves more of administering activities the goal of which is setting the amount and further enforcing this unpaid local fee. In my thesis I have drawn not only from the listed literature and magazines, but also from my own experience gain in work practice where I personally take part in administering local fees as an official of an autonomous area, a municipality.
