Concluding of insurance policies with implementation of new Civil Code

Abstract:

Diplomová práce se zaměřuje na uzavírání pojistných smluv podle NOZ (nový občanský zákoník), který vstoupil v platnost 1. ledna 2014. Zejména na analýzu pojistné smlouvy a následnou komparaci jednotlivých ustanovení s předešlou právní úpravou. Obsah práce je zaměřen zejména na uzavírání, změnu a zánik pojištění s uvedením jednotlivých změň a povinností jak pro pojistitele a pojišťovací zprostředkovatele tak pro pojištěné. Hlavním cílem práce je analyzovat a přiblížit význam pojišťování a výčet nových povinností pro obě smluvní strany při uzavírání, změně a zániku pojistných smluv dle právní úpravy nového občanského zákoníku. Vedlejším cílem práce je poukázat na změny v náhradě škody před a s platností nového občanského zákoníku a zjistit, zda jsou tyto změny přínosné a zda mají za cíl ochránit poškozeného.

Abstract:

The master thesis deals with concluding of insurance policies with effective date of an implementation of new Civil Code which came into force as of 1st January 2014. The master thesis is especially focused on analysis of insurance policy itself followed by comparison of particular clauses of former legal insurance regulation with newly implemented insurance legislation contained in new Civil Code. Furthermore the master thesis deeply clarifies process of concluding of insurance policies, potential changes being made during insured period and cancelation terms of the insurance while exact contractual and legal obligations of insurer, insurance intermediary as well as insured are determined. The main goal of the master thesis is an analysis of insurance in general and clarification of new insurance legal obligations of both parties during the process of concluding insurance policy, potential changes being made during the insured period and determining of cancelation terms. All these obligations are linked to new Civil Code which was already implemented. Besides of the main goal of the master thesis further distinctions and changes are pointed out. Especially changes related to liability of compensation of the damage caused to third party regardless material or non-material damage prior to commencement of new Civil Code and after its implementation into Czech legal system. With respect to this comparison there is furthermore determine if legal changes contained in new Civil Code have positive impact in relation of legal defense of damaged party.
