The Legal Name in a New Civil Code

Abstract:

Tato práce se zabývá právní úpravou obchodní firmy v novém občanském zákoníku. První kapitola je zaměřena na vymezení pojmu obchodní firma, její funkce, její základní dělení a zásady firemního práva. Druhá kapitola popisuje předchozí právní úpravu firmy, která byla obsažena v obchodním zákoníku, a vymezuje její základní problémy. Jádrem práce je kapitola třetí, pojednávající o úpravě obchodní firmy v novém občanském zákoníku a porovnávající novou úpravu s úpravou dosavadní. Závěr shrnuje základní poznatky práce a obsahuje autorovo zamyšlení nad perspektivou firemního práva.

Abstract:

This thesis focuses on regulation of a legal name in the New Civil Code. The first chapter is focused on definition of the term legal name, its functions, its basic division and principles of legal name law. The second chapter describes previous legal name regulation contained in the Commercial Code and defines its fundamental issues. The third chapter dealing with legal name regulation in the New Civil Code and comparing this regulation with previous regulation is the core of the thesis. The last part of thesis summarizes essential conclusions of the thesis and contains author’s consideration about perspective of a legal name law.
