Abstract:

Mlčenlivost a neveřejnost byly dlouho vnímány jako základní principy mezinárodní obchodní arbitráže. V nedávné době se však objevila touha učinit mezinárodní obchodní arbitráž více transparentní. Diplomová práce si klade za cíl pomocí metod deskriptivní analýzy a komparace vyvažovat požadavek transparentnosti oproti zásadám mlčenlivosti a neveřejnosti, zmapovat současné projevy transparentnosti v mezinárodní obchodní arbitráži, posoudit, zda v současné době existuje v mezinárodní obchodní arbitráži prostor pro více transparentnosti a porovnat vývoj v této oblasti s mezinárodní investiční arbitráži.

Abstract:

Confidentiality and privacy (non-publicity) have long been perceived as fundamental principles of international commercial arbitration. However, recently there has been a desire to make international commercial arbitration more transparent. The thesis aims to use the methods of descriptive analysis and comparison to balance the requirement of transparency against the principles of confidentiality and privacy, to map the current manifestations of transparency in international commercial arbitration, to assess whether there is currently room for more transparency in international commercial arbitration and to compare the developments in this area with international investment arbitration.
