Legal Aspects of Territory Protection of Nature in the Czech Republic in Relation to Nature 2000 Network

Abstract:

Ve své disertační práci jsem se zabýval jen jedním z mnoha aspektů, které sebou myšlenka vytvoření evropské soustavy chráněných území Natura 2000 nese, tj. právními aspekty územní ochrany přírody v České republice ve vztahu k soustavě Natura 2000. V rámci popisu a rozboru stávající právní úpravy soustavy Natura 2000 v českém právním řádu jsem se nejprve věnoval především důkladnému rozboru právní úpravy ptačích oblastí a evropsky významných lokalit, které u nás společně vytváří soustavu Natura 2000. Je přitom zřejmé, že Natura 2000 s sebou přinesla významné dopady z pohledu využití stávajících právních institutů územní ochrany přírody a krajiny. Protože je v rámci právní úpravy Natury 2000 v procesu vytváření SACs kladen v české legislativě velký důraz na smluvní ochranu, která má dánu dokonce přednost před ochranou formou zvláště chráněného území, zaměřil jsem svoji pozornost právě na právní úpravu tohoto institutu. O něco menší pozornost jsem pak věnoval druhé z možností územní ochrany evropsky významných lokalit – institutu zvláště chráněného území, který je na rozdíl od ochrany smluvní v ochranářské praxi velmi dobře znám a rovněž i využíván (byť samozřejmě ne v tak „masovém“ měřítku, jako tomu bude v několika nejbližších letech). K obecné využitelnosti institutu smluvní ochrany jsem přitom po provedené analýze stávající právní úpravy mírně řečeno skeptický a mám velké obavy z toho, zda tento institut naplní alespoň část z očekávání, které do něj mnohé subjekty vkládají. S různou intenzitou a hloubkou jsem se pak v přecházejících kapitolách zabýval rovněž i celou řadou právních otázek spojených s územní ochranou soustavy Natura 2000. Postupně jsem se podrobněji věnoval problematice vztahu evropsky významných lokalit a ptačích oblastí ke stávajícím zvláště chráněným územím, obecné územní ochraně přírody a krajiny a pozemkovým úpravám. Zaměřil jsem se dále i na souvislosti mezi územní ochranou soustavy Natura 2000 a katastrálním zákonem a alespoň stručně jsem nastínil i vazby ve vztahu k novému stavebnímu zákonu. Snažil jsem se přitom na vhodných místech identifikovat a popsat případné problémy, které by mohly být spojeny s vytvářením a ochranou soustavy Natura 2000 v praxi. Při hodnocení úspěšnosti transpozice a implementace příslušné evropské legislativy, tj. směrnice o stanovištích a směrnice o ptácích, jsem došel k závěru, že transpozice evropských směrnic v oblasti územní ochrany, která je předmětem této práce, proběhla relativně dobře. Přesto je možné v zákoně o ochraně přírody identifikovat několik míst, kterým se při transpozici nevyhnuly určité nedostatky a nedůslednosti. Na tato místa jsem se snažil poukázat. Jejich případné odstranění souvisí především s postojem Evropské komise a zahájením tzv. infringementu proti České republice. V současnosti probíhá postupná implementace, která začala z časového hlediska poněkud opožděně. Rovněž jí se ovšem od počátku celého procesu nevyhnula některá zřejmá pochybení (tj. nevymezení některých ptačích oblastí nebo jejich vymezení v rozporu s evropskou legislativou), která budou muset být dříve či později odstraněna. V případě dvou ptačích oblastí Komárov a Heřmanský stav - Odra – Poolší byl již infringement ze strany Evropské komise s Českou republikou zahájen. Z analýzy české právní úpravy je zřejmé, že stávající právní úprava některých ustanovení zákona o ochraně přírody souvisejících ať již přímo či nepřímo s Naturou 2000 není příliš jasná a vyvolává pochybnosti. ustanovení u nichž je zřejmé, že by měla být (a to nejen ku prospěchu soustavy Natura 2000) upravena vhodnějším způsobem. Právě na tyto případy jsem se rovněž snažil upozornit v samostatné kapitole nazvané příznačně De lege ferenda. Za nejpodstatnější návrh přitom jednoznačně považuji myšlenku tzv. základní ochrany evropsky významných lokalit jejíž právní úprava vychází z postavení a ochrany osvědčeného institutu významného krajinného prvku. Tato forma územní ochrany by dle mého podstatně zjednodušila, urychlila a rovněž i zlevnila proces vytváření soustavy Natura 2000. Současně by mohla mnohem lépe než je tomu reálně v případě formy smluvní ochrany učinit existenci Natura 2000 významně přijatelnější i pro vlastníky dotčených pozemků.

Abstract:

The topic of my postgraduate work is „Legal aspects of territory protection of nature in the Czech Republic in relation to Natura 2000 network“. The introductory chapters describe the concept „Natura 2000“ and the European legislation. Natura 2000 is a coherent European ecological network with assigned susceptible preservation, shall enable the natural habitats and species˘ habitats concerned to be maintained or, where appropriate, restored at a favourable conservation statues in their natural range. Each member state of the European Union has contributed to the creation of Natura 2000 network in proportion to the representation in its territory of the natural habitat types and the habitats of species for which the network is to be declared. The law base of Natura 2000 is formed by the European Directive 79/409/EEC on the conservation of the wild birds (so called „Directive on birds“) and the European Directive 92/43/EEC on the conservation of the natural habitats and of wild fauna and flora (so called „Directive on habitats“). These directives enable designation of two types of the protected areas – Special Protected Areas (SPAs) and Special Areas of Conservation (SACs) which together constitute the Natura 2000. Special Protected Areas are designated by the Member States of EU according to the Directive on birds for bird species mentioned in Annex I and also for migratory bird species. The declaration of Special Areas of Conservation is more complicated and difficult. In the first step the Member State draws up the list of proposed Sites of Community Interest (pSCI) according to the criteria in Annex III of the Directive on habitats. Then the proposed Sites of Community Interest are agreed on by the European Commission on the bio geographic seminar where the subjects of bilateral negotiations are. Finally the Member State shall designate the Sites of Community Interest as the Special Areas of Conservation within six years. The main purpose of this work is the analysis of the Czech legal order (above all Law on the protection of nature and the landscape) in connection to the territorial aspects of Natura 2000. The idea of Natura 2000 constitutes a new approach to the territory protection of nature in the Czech Republic. The significant factors of this new approach are: 1) the mapping of the whole territory of the Czech Republic (for the purpose of the identification of the Sites of Community Importance); 2) the method of the choice of the Sites of Community Importance and SPAs (only on the base of the relevant scientific information and the criteria set out in directives / decisions of the European Court of Justice); and 3) the enforceable obligation of the transposition and implementation of the European directives. In the Czech Republic there is the nature protection according to the Law No. 114/1992 Coll., on the protection of nature and the landscape (further only Law on the protection of nature). In the connection to the entry of the Czech Republic into the European Union the Czech legal order had to be changed. By approval of the Law No. 218/2004 Coll., which upgraded Law on the protection of nature, the transposition of the legislative base for drafting, creating and protecting areas of Natura 2000 was done. The so-called „Bird areas“ and „Important European Areas“ constitute Natura 2000 in the Czech Republic. Bird areas correspond to the Special Protected Areas under the Directives on birds. Bird area is original institute of the territory nature protection. There are 38 bird areas in the Czech Republic now (8,8 % of the area of Czech Republic). The final number will be 41 bird areas. Important European Areas are created for the protection of the types of European important habitats and European important species of fauna and flora. than 9 % of the area of Czech Republic). The final number of Important European Areas will be certainly more than one thousand (may be 1101 localities). All Important European Areas are or will be protected by the institute of special protected area or by the institute of the contractual protected area. The idea of contractual protection of the Sites of European Importance constitutes many legal questions. In my opinion the use of the form of the special protected area is more convenient than the form of the contractual protection or the protection of the Sites of Community Importance. Then I deal with the other questions related to the legal aspects of territory protection of Natura 2000, for example, the land planning, the financial compensations or the process of the assessment of some plans and projects likely to have significant affect on the Sites of Community Importance and Birds areas. One of the activities able to affect these areas are special land arrangements which on the other side may be a unique chance for design and realization of the many useful measures in interest of the nature and landscape including Natura 2000. The final chapters of this work refer to the implementation and transposition of the European directives into the Czech legal order; the creation Natura 2000 in practise and the proposals de lege ferenda in the Czech legislation. In my opinion the transposition of Natura 2000 into Czech legislation was done with some exceptions correctly. The implementation of Natura 2000 has not been finished because the Natura 2000 will not be released until 2014. The Czech Republic was accused of the infringement in the connection to the implementation of Natura 2000 in European Court of Justice. The reason was wrong designation of the bird area Komárov. I think that the establishment of Natura 2000 is one of the key steps in the protection and maintenance of the natural treasures in the territory of EU for the future generations.
