Informační povinnosti podle obecného nařízení o ochraně osobních údajů

Abstract:

Obecné nařízení o ochraně osobních údajů (ONOOÚ) ukládá správcům řadu in-formačních povinností. Cílem této práce je pokusit se o analýzu několika často diskutovaných právních otázek týkajících se informačních povinností dle článků 13 a 14 ONOOÚ a o poskytnutí doporučení ohledně právního výkladu těchto otázek. Zavedená metodologie právního výkladu právních předpisů na základě gramatické, systematické, historické a teologické analýzy bude doplněna o zásadu „effet utile“. Za tímto účelem budou analyzovány praktické přínosy informací o ochraně osob-ních údajů na základě údajů o přístupu k webovým stránkám. V práci bude vypočten poměr celkového počtu návštěvníků webových stránek a návštěvníků, kteří si zo-brazí stránku s informacemi o ochraně osobních údajů. Tento poměr lze použít jako argument pro či proti informačním povinnostem, jelikož z něj bude zřejmé, jak důležité jsou obecně tyto informace pro jednotlivce. Na základě této analýzy budou v práci také uvedena doporučení týkající se ukládání správních pokut za nesplnění informačních povinností. Případ bude porovnán se zavedenou judikaturou v oboru. Dále budou poskytnuta doporučení pro podniky ohledně plnění informačních pov-inností takovým způsobem, aby se s největší pravděpodobností vyhnuly vysokým pokutám. Posléze bude poukázáno na části nařízení, ve kterých právní výklad vede k výsledkům, které se zdají být neopodstatněné, nebo které by měly být (de lege ferenda) v následující aktualizaci ONOOÚ upraveny.

Abstract:

The EU General Data Protection Regulation (GDPR) imposes a number of infor-mation duties onto data controllers. This work will try to analyse a number of fre-quently discussed legal questions surrounding the information duties under Arti-cles 13 and 14 GDPR and provide recommendations on how these questions should be legally interpreted. The established methodology of legally interpreting a statute based on a grammatical, systematic, historical, and teleological analysis will be sup-plemented by effet utile considerations. To this end, the practical benefit of data protection information will be analysed based on website access numbers. The paper will determine the ratio between the total numbers of visitors of a website in com-parison to how often they visit the page that displays data protection information. This ratio can be used to argue against or in favour of information duties, since they reveal the importance such information commonly has for individuals. Based on this analysis, the work is also going to make suggestions regarding the imposition of administrative fines for failure to meet the information duties. It will compare this to the established case law in the field. It will try to provide recommendations for busi-nesses on how to implement the information duties with a fair chance of avoiding high fines. It will also highlight where the legal interpretation leads to results that seem unjustified or that should – de lege ferenda –be refined in a future update of the GDPR.
