Abstract:

Diplomová práce nastiňuje problematiku zadávání veřejných zakázek jako nástroje sloužícímu při hospodaření a přerozdělování veřejných finančních prostředků. Jedním z atributů zadávání veřejných zakázek je problematika možností obrany proti postupu zadavatele. Začínají podáním námitek proti úkonům a postupům zadavatele, či vyloučením účastníků ze zadávacího řízení. Námitky podle § 241 odst. 2 písm. c) Zákona č. 134 /2016 Sb. o zadávání veřejných zakázek představují významný nástroj v rukou dodavatelů. Argumenty v námitce mohou být čistě subjektivní názor stěžovatele. Je tedy otázkou, do jaké míry si dodavatelé stěžují na nezákonný postup zadavatele a kdy jen chtějí nabourat hospodářskou soutěž nebo si vyřizovat účty, či hájit své zájmy. O oprávněnosti námitek následně většinou rozhodne až ÚOHS. Podstatná část práce je tedy zaměřena na postupy a možnosti ochrany proti úkonům zadavatele, na pravomoci ÚOHS řešit problémy při realizaci veřejných zakázek dle zákona i mimo zákon. Na praktických příkladech bude demonstrován názor ÚOHS a návodný postup pro další zadávání veřejných zakázek pro zadavatele nebo pro dodavatele, kteří se této soutěže chtějí zúčastnit. Praktická část se bude věnovat dodržování základního pravidla veřejných zakázek, tedy transparentnosti, nediskriminaci, chybám v zadávacích postupech, možnosti objasnění, či změně nabídky, stanovením předpokládané hodnoty nebo druhu zadávacího řízení. Závěr bude patřit zamyšlení nad smyslem rozhodovací praxe, nad úmysly dodavatelů i zadavatelů v boji hospodářské soutěže.

Abstract:

This diploma thesis outlines the issue of public procurement as a tool used in the management and redistribution of public finance. One of the attributes of public procurement is the issue of the possibility of defence against the contracting authority's procedure. The defence begins with filing objections against the acts and procedures of the contracting authority, or the exclusion of participants from the tender process. Objections pursuant to § 241 para. c) of Act No. 134/2016 Coll. on Procurement are an important tool in the hands of suppliers but may represent a purely subjective opinion of the complainant. It is not clear, however, whether suppliers complain about the contracting authority's illegal conduct or whether they only want to distort competition, settle accounts, or defend their interests. Usually, the Office for the Protection of Competition will decide on the legitimacy of the objections. A substantial part of the thesis is therefore focused on the course of action and options of protection against the acts of the contracting authority, and the authority of the Office over solving problems connected with the implementation of public procurement under the law and outside the law. Practical examples will demonstrate the opinion of the Office and a guideline for further public procurement intended for the contracting authorities or suppliers wishing to take part in this competition. The practical part will focus on compliance with the basic public procurement directives i.e., transparency, non-discrimination. It will also pay attention to errors in procurement procedures, the possibility of clarification or changes in an offer, and determining the expected value or type of procurement procedure. The conclusion will reflect on the meaning of decision-making practice and on the intentions of both suppliers and contracting authorities in the fight against competition.
