The Process of Risk Assessment in Regards to Non-Cooperative Jurisdictions as per FATF

Abstract:

Diplomová práce se zabývá procesem hodnocení rizik vycházejícím z mezinárodních standardů FATF. Problematika procesu hodnocení rizik je relativně nová, proto práce skrze svoji úvodní část předestírá základní vhled do pojmosloví problematiky, které je nedílnou součástí pochopení procesu hodnocení rizik a jeho fungování v praxi. Úvodní kapitoly nabízí čtenáři informativní rámec, který je dále rozveden skrze kapitoly následující, ve kterých je proces hodnocení rizik zmapován s ohledem na jeho jednotlivé fáze, úkoly a poslání nejen na úrovni státu, nýbrž i ve vztahu k povinným osobám. Následně je provedena reflexe procesu hodnocení rizik, boje proti praní špinavých peněz a financování terorismu ve vztahu k nespolupracujícím jurisdikcím. Čtenář má možnost zjistit, jaký mohou mít proces hodnocení rizik a s ním související opatření na jurisdikce praktický dopad a pohlédnout na rizikovost, kterou nespolupracující jurisdikce oplývají. V neposlední řadě, a to v rámci páté kapitoly, dochází k sumarizaci získaných poznatků, na základě kterých autorka formuje vlastní kritický pohled na problematiku a poukazuje na její problematické aspekty s možností jejich zefektivnění.

Abstract:

The diploma thesis deals with the process of risk assessment based on international FATF standards. The issue of the risk assessment process is relatively new, so the thesis through its introductory part provides a basic insight into the terminology of the issue, which is an integral part of understanding the risk assessment process and its operation in practice. The introductory chapters offer the reader an informative framework, which is further elaborated through the following chapters, in which the risk assessment process is mapped with regard to its individual phases, tasks and missions not only at the state level, but also in relation to liable persons. Subsequently, the process of risk assessment, the fight against money laundering and terrorist financing in relation to non-cooperating jurisdictions is reflected. The reader has the opportunity to find out how the risk assessment process and related measures can have a practical impact on the jurisdictions and to look at the riskiness that the non-cooperative jurisdictions have. Last but not least, within the fifth chapter, the acquired knowledge is summarized on the basis of which the author forms her own critical view of the issue and points out its problematic aspects with the possibility of their streamlining.
