Acquisition of Ownership by the State

Abstract:

Stát jako autorita je vlastníkem nemalého majetku. Ten potřebuje k plnění svých ekonomických a dalších funkcí, které vykonává. Ovšem není schopen s ním hospodařit pouze sám. Proto zřizuje subjekty, kterým toto právo přenechává, s majetkem státu je oprávněna jednat jménem státu kterákoli organizační složka státu nebo státní organizace či Úřad pro zastupování státu ve věcech majetkových. Nejčastějším důvodem nabytí majetku státem je smlouva. Proto se nabývání rozlišuje na smluvní a jiné způsoby. Do smluvního řadíme bezúplatné smluvní a úplatné smluvní nabývání. Tato práce je rozdělena do jednotlivých kapitol a snaží se o přiblížení problematiky státu, vysvětluje, jakými způsoby lze nabýt majetku státem, posuzuje, zda je právní úprava dostatečná a v závěru práce posuzuje návrh nového občanského zákoníku.

Abstract:

The state as an authority is the proprietor of large possessions. It needs the property to perform its economic and other functions which it executes. But the state is not able to manage it alone. Therefore, the state establishes entities to which it delegates the right. An organizational unit of state or government organizations or the Office of the Government Representation in Property Affairs of state property can act on behalf of the state in matters of property. The most common reason for the acquisition of property by the state is a contract. Therefore, a distinction is made on contractual and other means. Gratuitous and onerous contractual acquisition are included into contractual aquisition. This thesis is divided into chapters and it tries to apporoach the issues of state, it considers whether legislation is sufficient or not and the conclusion assesses the design of the new Civil Code.
