Legal Aspects of Statement of the Place of Residence

Abstract:

Cílem této práce je rozbor právních předpisů na úseku evidence obyvatel, zejména ve vztahu k údaji o místu trvalého pobytu. Vymezuje jak hmotné tak i procesní právo dané problematiky. Zabývá se podmínkami pro získání trvalého pobytu v České republice ve vztahu k občanu, změnou, zrušením a ukončením trvalého pobytu. Na základě tohoto rozboru jsou popsána práva a povinnosti jednotlivých subjektů. Blíže se práce zabývá správním řízením ve věci zrušení údaje o místu trvalého pobytu a dopady adresy sídla ohlašovny jako údaje o trvalém pobytu občana, ve vztahu k doručování, volebnímu právu, místní příslušnosti a exekuce. Využity jsou poznatky z praxe, na jejichž základě jsou vypracovány závěry autora a možné řešení problémů na úseku evidence obyvatel.

Abstract:

The aim of this thesis is to analyse the legal enactments concerning evidence of citizens, particularly data about the place of permanent residency. It determines substantive law as well as procedural law on this matter. It deals with conditions for gaining permanent residency in the Czech Republic in relation to citizenship, change, cancellation and ending of permanent residency. The rights and duties of individual subjects are described on the basis of this analysis. More closely this thesis deals with the administrative procedures concerning cancellation of the place of permanent residency and the impacts of having the address of registration office as the place of permanent residency, in the matters of delivery, right to vote, territorial pertinence and distrait. There are practise findings used in this thesis, and on their basis the author’s conclusions and possible solutions in the field are drawn up.
