Diminished sanity and irsanity in criminal law

Abstract:

Tato diplomová práce pojednává o duševním stavu pachatele v trestněprávním významu. Snahou práce je podrobně rozebrat rozdíly mezi stavem normálním, resp. pravidelným (tj. příčetnost) a stavem, který u pachatele trestného činu vznikne, když je v době činu ovlivněn duševní poruchou ve smyslu ustanovení § 123 trestního zákoníku, jež působí na pachatelovu schopnost rozpoznat protiprávnost činu (rozumová, rozpoznávací složka pachatelova jednání) nebo pachatelovu schopnost vlastní vůlí ovládat své jednání (volní, ovládací neboli určovací složka pachatelova jednání), anebo na obě pachatelovy způsobilosti jednat zároveň (tj. zmenšená příčetnost nebo dokonce nepříčetnost). U každého stavu platí specifický právní režim patrný již v samotném přístupu k trestní odpovědnosti pachatele a jeho trestním postihu. Rozdílnost právního systému vychází především z osobnosti pachatele, kdy je zcela zásadní, zda se jedná o dospělého jedince nebo o mládež dle ustanovení § 2 písm. b) a d) zákona o soudnictví ve věcech mládeže. V duchu tohoto dělícího kritéria je pak diplomová práce koncipována.

Abstract:

This master thesis deals with mental health of the perpetrator in the sense of penal law. Purpose of this thesis is to analyze in detail the differences between normal mental health and the regular (i.e. sanity) mental health, which occurs at the perpetrator of a crime, if the perpetrator is influenced by a mental disease at the time of committing the crime in the meaning of enact § 123 penal code, that affects on the perpetrator?s ability to recognize the illegality of the act (intellectual, recognizing component of the perpetrator?s act) or perpetrator?s ability to control the his or her act (volitional, controlling or determining component or the perpetrator?s act) by the help of his or her own will, or on both: perpetrator?s capacity to act simultaneously (i.e. diminished sanity or even insanity). There is specific law regime for every mental state which is obvious to oneself?s own approach to criminal responsibility of the perpetrator and his criminal sanction. The Difference in legal system arises mainly from the personality of the perpetrator. The crucial issue is whether we deal with an adult or with a youth according to § 2 letter b) and d) judiciary in the matter of youth act (Act 218 of 2003). This thesis is composed in the meaning of this dividing criterion.
