Legal mode of the ground in the function for nature protection

Abstract:

Ochrana přírody je obvykle chápána odděleně ve dvou rovinách. Jednak jde o ochranu vzácných a ohrožených druhů rostlin a živočichů – ochrana druhová, jednak o snahu zachovat jedinečné nebo člověkem nedotčené oblasti – ochrana územní (ekosystémová). Pro záchranu živé přírody v celé její rozmanitosti je pak nutné obě tyto roviny propojit. Zákon č. 114/1992 Sb., o ochraně přírody a krajiny vymezuje dva typy ochrany přírody – obecnou a zvláštní. Problematika pozemků sloužících ochraně přírody je v našem právním řádu upravena hlavně zákonem č. 114/1992 Sb., o ochraně přírody a krajiny, ale i dalšími právními předpisy. Jedná se o moderní právní normu, která je ve svých zásadních principech v souladu s evropským i celosvětovým trendem v ochraně přírody. Po přijetí tzv. euronovely (zákon č. 218/2004 Sb.) je navíc naše právní úprava posunuta z národního do evropského kontextu a územní i druhová ochrana přírody je plně kompatibilní s právem Evropských společenství. Národní soustava zvláště chráněných území, která existovala na území České republiky před zavedením soustavy Natura 2000 do zákona o ochraně přírody a krajiny, byla poměrně reprezentativní a zajišťovala ochranu nejcennějších ekosystémů a stanovišť druhů z pohledu národního. Tzv. euronovela s sebou přinesla právní nástroje pro vytvoření české součásti evropské soustavy chráněných území Natura 2000 a harmonizaci ochrany ohrožených druhů rostlin a živočichů v evropském měřítku. Zatímco právní úprava vlastnictví pozemků ve stávajících zvláště chráněných územích byla založena na principu upřednostňování státního vlastnictví k těmto pozemkům z důvodu lepšího zajištění ochranných podmínek a odpadnutí povinnosti platit finanční náhrady za omezení hospodaření vlastníků z důvodu ochrany přírody, soustava Natura 2000 je naopak mimo jiné založena na myšlence spolupráce vlastníků dotčených pozemků s příslušnými orgány ochrany přírody při tvorbě ochranných podmínek pomocí institutu smluvní ochrany podle § 39 zákona o ochraně přírody a krajiny. Zařazení konkrétního území do soustavy Natura 2000 tak ve většině případů nemá mít za následek vyloučení jejich hospodářského využívání. Naopak mají být vytvořeny podmínky šetrného hospodářského využívání s případnou možností využití prostředků finanční podpory z Kohezního a strukturálních fondů a doprovodných opatření společné zemědělské politiky Evropské unie. Institut smluvní ochrany však zatím v praxi využit nebyl. Je otázkou, zda se tak děje z nedostatku zájmu vlastníků dotčených pozemků nebo z důvodu jejich malé informovanosti o této možnosti či kvůli obavám ze složitosti procesu. Podle mého názoru by k většímu využívání institutu smluvní ochrany přispěla lepší osvěta a informovanost vlastníků dotčených pozemků, což by měla zajišťovat intenzivnější spolupráce s pracovníky orgánů ochrany přírody. Možnost uzavřít smlouvu podle § 39 se vyčerpá uplynutím zákonem stanovené lhůty. Tato lhůta je prekluzivní, takže špatně informovaní vlastníci již v budoucnu nemají možnost tuto smluvní ochranu založit. Navíc při jejím rušení je vlastník v nerovnoprávném postavení vůči orgánu ochrany přírody. Pokud by tedy měl přínos soustavy Natura 2000 spočívat v něčem jiném než jen v rozšíření stávajících zvláště chráněných území o nová, měl by mít podle mého názoru vlastník pozemku větší dispoziční právo k uzavírání a rušení této smluvní ochrany.

Abstract:

Nature is usually considered separately in two planes. First, it regards the protection of rare and endangered species of flora and fauna - the protection of species, and the efforts to preserve unique or man untouched areas - protection of land (ecosystem). For the rescue of live nature in all its diversity is necessary to link these two planes. Act No. 114/1992 Coll. On the protection of nature and landscape defines two types of nature - the general and specific. The issue of land used by the protection of nature is in our legal system governed mainly by law No. 114/1992 Coll. On the protection of nature and landscape, but also in other legislation. It is a modern legal standard, which is in its fundamental principles in accordance with European and global trends in nature conservation. Following the adoption of the so-called euronovely (Act No. 218/2004 Coll.) Moreover, our legislation shifted from the national to the European context and territorial species and nature protection is fully compatible with the law of the European Communities. The national system of specially protected areas, which existed in the Czech Republic before the introduction of Natura 2000 into law on the protection of nature and the landscape was fairly representative, and the protection of the most valuable ecosystems and habitats of species from the perspective of the national. The so-called. euronovela bring legal instruments for the creation of the Czech part of the European network of protected areas Natura 2000 network and the harmonization of the protection of endangered species of flora and fauna on a European scale. While the legislation of land ownership in the existing specially protected areas was based on the principle of preference for state ownership to this land due to better ensure protection conditions and the abolition of the obligation to pay compensation for restrictions on the management of owners for the protection of nature, Natura 2000 network, on the other hand, inter alia, based on idea of cooperation of the owners of land with the competent authorities of nature in the production of protective conditions of the Institute through contractual protection under Section 39 of the Law on the protection of nature and landscape. The inclusion of a specific territory within the Natura 2000 network and in most cases does not entail the elimination of economic exploitation. On the contrary, to be created sound conditions for the economic exploitation of the possibilities of using any means of financial support from the Cohesion and Structural Funds and the accompanying measures the common agricultural policy of the European Union. Institute of contractual protection, however, has been used in practice. It is questionable whether it is lack of interest from owners of the land or because of their low awareness of this possibility and because of concerns about the complexity of the process. In my view, the Institute for greater use of contractual protection has a better education and information for owners of the land, which should ensure increased cooperation with the staff of the nature protection. The possibility to conclude a contract under Section 39 is exhausted, the end of the statutory deadline. This period is preclusive, so ill-informed owners in the future have the possibility to establish a contractual protection. Moreover, when interference is the owner of the underprivileged position against the body of nature. Therefore, if the contribution of the Natura 2000 network consist of something other than just the extension of existing specially protected areas of new, should have, in my view, the owner of land greater disposition of the conclusion of this contract and interference protection.
