Correction of Errors in Land Register Data

Abstract:

Cílem mé bakalářské práce je popis institutu opravy chyb v katastrálním operátu, jak po stránce procesní, tak po stránce věcné. Nejdříve uvádím definice základních pojmů, jejichž znalost je nezbytná a dále popisuji správní orgány, které zasahují nebo mohou zasahovat do státní správy na úseku katastru nemovitostí. Následuje kapitola popisující základní zásady katastrálních orgánů při vedení katastru nemovitostí. Podrobně se zabývám pojmem „chyba v katastrálním operátu“. V této práci se detailně nezabývám popisem dřívějších evidenčních nástrojů, ale zaměřuji se alespoň na popis dřívějších právních úprav opravy chyb. Následuje stručný popis právní úpravy po 1. lednu 1993 až do současnosti, kdy došlo k několika novelizacím prováděcích předpisů a významné je také datum 1. ledna 2006, kdy nabyl účinnosti nový správní řád. Stěžejní část práce spočívá v popisu procesního postupu katastrálního úřadu při opravě chyby v katastrálním operátu, ve všech jeho etapách, od návrhu na opravu chyby přes oznámení o povedení nebo neprovedení opravy chyby až po případné správní rozhodnutí. Nemohl jsem zapomenout ani na popis ochrany práv osob dotčených opravou chyby, spočívající v řádných případně mimořádných opravných prostředcích. Bakalářskou práci uzavírám stručným popisem žaloby ve věci opravy chyby v katastrálním operátu.

Abstract:

The aim of my bachelor thesis is the description of the institute of correcting errors in Land Registry, from the procedural and substantive point of view. Firstly, I present definitions of basic concepts, whose knowledge is necessary and further I describe the institutions that interfere or may interfere to the state administration in terms of Land Registry. The following chapter describes the basic principles of Land Register authorities in management of Land Register. I closely deal with the concept ‘error in the Land Register survey’. I do not deal with the description of prior registration tools in this work but at least I focus on the description of prior legislation fixes of errors. Then follows a brief description of the legislation after 1 January 1993 up to now, when several amendments of implementing regulations occurred. The date 1 January 2006 is also important since new Administrative Procedure came to force. The central part of the work is the description of the Land Register procedure in the correction of a mistake in the Land Register, in all its phases, from the motion to correct the mistake, through realization or not realization of the correction, to eventual administrative decision. I could not forget the description of the rights protection of persons who were affected by the correction of an error, consisting of ordinary or extraordinary remedies. My bachelor thesis ends with a brief description of an action in the matter of the correction of an error in Land Register survey.
