Abstract:

Cílem bakalářské práce je identifikace úrovně legislativních znalostí zastupitelů městských částí hlavního města Prahy vycházejících ze zákona 250/2000 Sb., o rozpočtových pravidlech územních rozpočtů dle vybraných kritérií. Dále je za cíl kladeno vyhodnocení získaných poznatků a přednesení konkrétních doporučení, jež směřují k ověřování ale i zvyšování úrovně znalostí zastupitelů městských částí hl. m. Prahy. Dvacet sedm zastupitelů podrobených šetření, tedy 75 % z celkového počtu zúčastněných, dle zjištěných výsledků dosahuje vyšší jak 50% znalost zákona. Zbylých devět, jenž tvoří jednu čtvrtinu zúčastněných zastupitelů se nachází pod hranicí 50% úspěšnosti. Z výzkumu vyplynulo, že průměrná procentuální úspěšnost otázek zodpovídaných všemi zastupiteli činí 57 %. Z výsledků dále také vychází, že úspěšnost testu s věkem klesá a zúčastnění zastupitelé, kteří byli ve věku 56 a více let nedosáhli ani 50% úspěšnosti. Z hlediska počtu zvolení byli nejúspěšnější právě zastupitelé, kteří byli zvoleni více než třikrát, avšak jejich bohaté zkušenosti se výrazně neprojevily, neboť oproti druhé nejvíce úspěšné skupině, a to pouze jedenkrát zvolených zastupitelů, dosáhli vyšší úspěšnosti jen o 0,2 %. Nejvíce překvapujícím výsledkem je vyšší úspěšnost zastupitelů se středoškolským vzděláním nad zastupiteli s vysokoškolským vzděláním, a to o 4,3 %. Teoretická část práce zprvu představuje metodiku pro zpracování části praktické. Dále pak charakterizuje funkční členění hl. m. Prahy, na což navazují konkrétní pravomoci a právní postavení zastupitelů městských částí, jež jsou základním kamenem k pochopení důležitosti funkce zastupitele. Není zde opomenuto přiblížení zákona, z něhož jsou vytvořeny otázky do dotazníkového šetření. V závěru práce zasazuje téma do kontextu souvisejících ekonomických teorií. V praktické části je popsán postup dotazníkového šetření, které bylo nezbytné pro identifikaci úrovně znalostí zastupitelů provést. Konkrétně jsou rozebrány všechny dotazníkové otázky, skrze něž jsou prezentovány a komparovány výsledky na základě třech kritérií – věk zastupitelů, maximální dosažené vzdělání a počet zvolení do funkce zastupitele. Mimo jiné praktická část přináší doporučení, díky kterým by bylo možné ověřovat znalosti zastupitelů a případně je i zvyšovat. Hlavní doporučením je vznik propracovaného systému školení, jež by byla určená k rozšiřování úrovně znalostí zastupitelů po celé České republice. Za hlavní přínos práce považuji přiblížení významu funkce a pravomocí zastupitele a vytvoření vlastního systému zkoumání znalostí zastupitelů městských částí hl. m. Prahy, jenž lze obecně použít i na všechny zastupitele územně samosprávných celků po celé České republice.

Abstract:

This Bachelor's thesis aims to identify the chosen local representatives' legislative knowledge level of city districts of the capital city of Prague based on Act 250/2000 Coll., on budgetary rules of territorial budgets according to selected criteria. Another objective is to evaluate this gained knowledge and present the specific recommendations which are leading to verifying but also increasing the level of knowledge of the local representatives in the city districts in the capital city of Prague. According to the results, twenty-seven local representatives, who were surveyed, achieve more than 50% knowledge of the law, which is 75 % of the representatives. The remaining nine, who make one quarter of the participators are below the 50% success rate. The research showed that the average success rate of questions answered by all representatives is 57 %. The results show that the success of the test decreases with age and the participating representatives, who were aged 56 and over, did not achieve even 50% success rate. In terms of number of elections, the most successful were the representatives, who were elected more than three times, but their plentiful experience did not significantly show, whereas compared to the second most successful group, only once elected representatives, they achieved a higher success rate of only 0.2 %. The most surprising result is a higher success rate of representatives with secondary education over representatives with university education, by 4.3 %. The theoretical part of the work first introduces the methodology for elaboration of the practical part. Then it further characterizes the functional division of the capital city of Prague, followed by specific competencies and legal status of the local representatives of city districts, which are the basis for understanding the importance of the function of the local representative. You can also find here the approximation of the law from which the questions for the questionnaire survey are made. At the end of the theoretical part, the thesis places the topic in the context of related economic theories. the methodology for elaborating the practical part is presented. The practical part describes the method of the questionnaire survey, which was necessary to carry out for the identification of the level of knowledge of the local representatives. Specifically, all the questions from the survey are analyzed, through which the results are presented and compared based on three criteria – the age of the local representatives, the maximum education achieved and the number of elections for the position of the local representative. Among other things, the practical part brings forth recommendations, thanks to which it would be possible to verify the knowledge of the local representatives and eventually increase it. The main recommendation is the creation of a sophisticated training system, which would be designed to expand the level of knowledge of the representatives throughout the Czech Republic. I consider the main contribution of the work to be the approach to the importance of the function and the competencies of local representatives and the creation of its own system for verifying the knowledge of the local representatives of the city districts of the capital city of Prague, which can generally be applied to all representatives of territorial governing units throughout the Czech Republic.
