Strict Liability in Driving Offences Proceedings

Abstract:

Diplomová práce pojednává o přestupkovém řízení v dopravě ve vztahu k objektivní odpovědnosti. V úvodní části je představena historie správního trestání na území České republiky, následně je pojednáváno o současné právní úpravě. Uvedena jsou východiska právní úpravy řízení o přestupcích a zejména řízení o přestupcích v dopravě. Správní delikt provozovatele vozidla zavedený novelou č. 297/2011 Sb., zákona č. 361/2000 Sb., o provozu na pozemních komunikacích, je v práci komplexně analyzován, což je hlavním cílem práce včetně posouzení otázky zvýšení efektivity trestání pachatelů přestupků. Prostor je věnován praktickému postupu správních orgánů v době před účinností této novely a po ní, včetně popisu jednání pachatelů přestupků s úmyslem vyhnout se postihu a reakce správních orgánů na tato jednání. Představeny jsou rovněž náměty de lege ferenda, a to okrajově v kontextu s Listinou zaručenými právy a zahraniční právní úpravou.

Abstract:

The thesis discusses the driving offences proceedings in relation to strict liability. The opening part of the thesis introduces the history of administrative punishment in the territory of the Czech Republic and then it introduces current legislation. The citations of legislation of administrative delict proceedings, particularly traffic administrative proceedings are being dealt with in the thesis. The vehicle operator administrative offence introduced to legislative by amendment no. 297/2011 Coll., Act no. 361/2000 Coll. is comprehensively analyzed in the thesis, which is the main goal of the thesis, including the assessment of increasing the efficiency of punishing an offender. The attention is also focused on practical procedure of administrative bodies at the time before the effect of the amendment and after it, including the description of the perpetrators of offenses, with the intent to avoid prosecution and response administrations of these actions. Legal regulations de lege ferenda, marginally in the context of the Charter of Rights and Freedoms guaranteed rights and international law, are also being dealt with in the thesis.
