Computerization of public procurement

Abstract:

Tato práce se zabývá elektronizací veřejných zakázek, která je v současné době velmi diskutovanou oblastí. Neustálá obměna legislativy a pravidel pro zadávání veřejných zakázek se stává častým terčem kritiky, diskusí a debat, a to zejména ze strany subjektů zadávacího řízení, tedy zadavatelů a dodavatelů, jichž se tyto změny týkají nejvíce. Cílem této diplomové práce je popsat konkrétní změny a procesy, které prostřednictvím elektronizace nastávají v životním cyklu veřejné zakázky. Zjistit, jaký má elektronizace dopad na praxi a popsat, jaké nové požadavky vyplývají z elektronického zadávání veřejných zakázek pro samotné zadavatele a dodavatele. Diplomová práce je rozdělena na dvě části, na teoretickou a praktickou část. První část práce je postavena na teoretickém základu, jemuž předcházela rešerše odborných zdrojů, který je posléze provázán s praktickou částí práce. Druhá část práce analyzuje životní cyklus veřejné zakázky na konkrétním příkladu z praxe, a to dle současného a minulého režimu zadávání veřejné zakázky. Oba režimy jsou popsány v souladu s příslušnými zákony. Konkrétní veřejná zakázka je vybrána prostřednictvím Národního elektronického nástroje a je členěna do několika fází. Závěr práce se skládá ze souhrnu dílčích výstupů práce, spolu s možným návrhem řešení problémových oblastí a zahrnuje otázky, jež jsou uvedeny v úvodu práce.

Abstract:

Currently frequently discussed topic of computerization frames a focus of this thesis on the computerization of public procurement. Fastly changing legislation and rules for the public procurement tendering are being highly criticized, especially by participants of the public procurement tendering, who are influenced by above mentioned changes the most. An objective of this diploma thesis is an analysis of specific changes and processes caused by the computerization, that occur in a life cycle of the public procurement. In addition to the previous goal, this thesis elaborates on the computarization impact on general practice, and describes what are new requirements for contracting parties, emerging from electronic input of public procurements. The proposed diploma thesis is divided into two parts, the first explains the topic in theory, the latter in practice. In the first part devoted to theoretical foundation, the thesis draws from an executed research of available scientific sources. This foundation is then interlinked to the practical part of the thesis, which analyses the life cycle of public procurement. The aforementioned part uses a specific example of public procurement input from practice, and its execution under current rules in comparison to the rule regime valid in the past. Both regimes are described in compliance with corresponding laws. The specific example of public procurement is chosen from The National Electronic Tool, and segmented into several phases. A summary of partial outputs of the thesis is included in the conclusion of the diploma thesis as well as answers on questions asked in an introduction part of the thesis.
