Enforcement of tax claims from the tax administrator point of view

Abstract:

Diplomová práce se zabývá problematikou vymáhání daňových nedoplatků v České republice. Popisuje předpoklady vymáhání daňových nedoplatků, činnost správce daně před zahájením daňové exekuce, proces vymáhání daňových nedoplatků a jednotlivém vymáhací instrumenty včetně zajišťovacích institutů. V aplikační části diplomové práce je navozena modelová situace procesu vymáhání v praxi. Obsahuje i deskripci nejčastějších chyb, kterých se daňový dlužníci při správě daní dopouští včetně vlastních doporučení k jejich minimalizaci. Aplikační část diplomové práce se dále zaměřuje na analýzu daňových nedoplatků v České republice včetně vyhodnocení efektivnosti jednotlivých vymáhacích nástrojů. Hlavním cílem diplomové práce je zpřehlednit veřejnosti jednání správce daně a poukázat na jejich efektivní práci, o čemž by měla vypovídat analýza obsažená v aplikační části diplomové práce. V diplomové práci bylo využito metod zkoumání, jako jsou deskripce, analýza, případová studie a dedukce.

Abstract:

This diploma thesis deals with the issue of recovering tax arrears in the Czech Republic. It describes the prerequisites for the recovery of tax arrears, the activity of the tax authority before the start of the tax proceedings, the process of recovering tax arrears and the individual enforcement instruments used, including hedging instruments. An example of the enforcement process in practice has been outlined in the Application section of the thesis. This section also contains a description of the most common mistakes made by taxpayers in tax administration and includes recommendations for their minimisation. The Application section further focuses on the analysis of tax arrears in the Czech Republic, including an evaluation of the effectiveness of individual enforcement instruments. The main objective of the thesis is to make tax administration more transparent for the public and to highlight the effective work the of tax authority. This is supported by the analysis contained in the Application section. In this thesis, research methods such as description, analysis, case study and deduction have been used.
