Powers of the President of the Czech Republic

Abstract:

Ve své diplomové práci na téma pravomoci prezidenta české republiky jsem v úvodní kapitole vysvětlil pojem prezidenta republiky. Další část byla věnována historii československých ústav, rozebral jsem požadavky na prezidentského kandidáta a pravomoci svěřené prezidentovi jednotlivými ústavami. Nejvýraznější změny přinesla ústava z roku 1960 a následně přímá volba prezidenta v roce 2012. V další části své práce jsem se věnoval současnému postavení prezidenta České republiky a vlivu přímé volby na jeho pravomoci. Přímá volba znamenala několik změn v ústavních zákonech, ale na prezidentovo postavení a pravomoci zásadní vliv neměla. Prezident není ze své funkce odpovědný, je jej možné stíhat pouze za velezradu, jediným trestem může být ztráta úřadu a nemožnost jej znovu získat. V posledních kapitolách jsem se vypořádal s problematikou kontrasignovaných a nekontrasignovaných pravomocí prezidenta. Tento rozbor jsem prokládal nejznámějšími kauzami či událostmi, které se daných pravomocí týkaly. V závěru diplomové práce jsem vyhodnotil vlastní dotazník zkoumající názory široké veřejnosti na pravomoci prezidenta České republiky. Z dotazníku vyplynulo, že český národ je názorově ztotožněn s faktem, že přímá volba prezidenta republiky nemá vliv na jeho postavení a pravomoci. Dále bylo zjištěno, že respondenti by rádi prezidentu odebrali pravomoci týkající se možnosti zasahování do moci soudní.

Abstract:

In my diploma work concerning the Powers of the President of the Czech Republic I firstly explained the concept of the President of the Republic. The next part was devoted to the history of the Czechoslovak constitutions, I analyzed the requirements for the presidential candidates and the powers given to the president by specific constitutions. The most significant changes came from the 1960 Constitution, followed by a direct presidential election in 2012. In the next part of my work I focused on the current position of the President of the Czech Republic and the influence of direct election on his powers. The direct election brought several changes in constitutional laws, but it had no major influence on the president's position and powers. The president is not responsible for his office, he can only be prosecuted for treason; the only punishment may be the loss of the office and the impossibility of regaining it. In the last chapters, I have dealt with the issue of the countersigned and uncontested powers of the president. I interspersed this analysis with the best-known cases or events that concerned the given powers. At the end of my work I evaluated my own questionnaire examining the public view on the powers of the President of the Czech Republic. The questionnaire emerged that the Czech nation think that the direct presidential election does not affect its position and powers. Furthermore, the respondents would like to take away the president's powers enabling the interference with judicial power.
