The role of the European Union in closing the borders of the Schengen Member States during the Covid-19 pandemic

Abstract:

Tato bakalářská práce zkoumá roli Evropské unie během uzavírání vnitřních hranic schengenského prostoru v průběhu pandemie Covid-19 a vliv proběhnutých událostí na budoucí řešení případných krizí. Práce je rozdělena na teoretickou a praktickou část. Teoretická část práce popisuje princip volného pohybu v rámci Evropské unie, obzvláště pak jeho právní ukotvení. Dále je popisován schengenský prostor a jeho členské státy, hranice prostoru a schengenský hraniční kodex, který stanoví pravidla schengenského prostoru. Poslední kapitola teoretické části se věnuje pandemií Covid-19. Analytická část poté nejdříve rozebírá šíření Covid-19 v zemích schengenského prostoru. Následně analyzuje reakci členských států v oblasti vnitřních hranic schengenského prostoru na šíření pandemie v návaznosti na pravidla schengenského kodexu. V druhé části je poté popsána reakce Evropské unie na uzavírání hranic členských států za pomocí analýzy vydaných nařízení a opatření Evropské komise. Závěr práce poté zodpovídá na stanovené výzkumné otázky.

Abstract:

This bachelor's thesis examines the role of the European Union during the closure of the internal borders of the Schengen area during the Covid-19 pandemic and the impact of past events on the future resolution of possible crises. The work is divided into theoretical and practical part. The theoretical part of the thesis describes the principle of free movement within the European Union, especially its legal basis. The Schengen area and its Member States, the borders of the area and the Schengen Borders Code, which lays down the rules of the Schengen area, are also described. The last chapter of the theoretical part then deals with the Covid-19 pandemic. The analytical part then first discusses the spread of Covid-19 in the countries of the Schengen area. It then analyzes the response of Member States in the area of the internal borders of the Schengen area to the spread of a pandemic following the rules of the Schengen Code. The second part then describes the European Union's response to the closure of Member States' borders through an analysis of issued regulations and measures of the European Commission. The conclusion of the thesis then answers the set research questions.
