The perpetrator as the entity of the crime

Abstract:

Tato bakalářská práce poskytuje pohled na současnou právní úpravu týkající se pachatele trestného činu, její problémy a nedostatky. První část se věnuje podmínkám trestní odpovědnosti fyzických osob, blíže se zabývá zejména institutem příčetnosti. Jedna z kapitol pojednává o vztahu pojmů pachatele a subjektu trestného činu. Tato práce se věnuje zejména fyzickým osobám, ovšem jedna z kapitol je zaměřena také na trestní odpovědnost osob právnických. Dále se práce věnuje pojmu trestné součinnosti – spolupachatelství a účastenství. Další důležitou částí této práce je část věnující se trestní odpovědnosti mladistvých. Pozornost je zaměřena zejména na rozumovou a mravní vyspělost. Následující část práce obsahuje komparaci naší právní úpravy s právní úpravou Slovenské republiky. Poslední část této bakalářské práce zpracovává stručný přehled výkladu pojmu pachatel a též různých typologií ve forenzních vědách, konkrétně v kriminologii, kriminalistice (behaviorální analýza) a forenzní psychologii. Pro zajímavost jsou součástí této práce též aktuální data, jež vyplývají ze statistik vedených Ministerstvem spravedlnosti a týkají se pachatele trestného činu.

Abstract:

This bachelor's thesis provides an insight into the current legislation regarding the perpetrator of a crime, its problems and shortcomings. The first part is devoted to the conditions of criminal liability of natural persons as perpetrators. It is above all dealing with sanity. One of the chapters discusses the relation between the terms of the perpetrator and the subject of the crime. This work is mainly devoted to natural persons but one of the chapters is also focused on the criminal liability of legal persons. The thesis also deals with the terms of criminal collaboration - complicity and participation. Another important part of this work is the part devoted to the criminal responsibility of juveniles. This part payes attention mainly to intellectual and moral maturity. The following part of the thesis contains a comparison of our legislation with the legislation of the Slovak Republic. The last part of this bachelor's thesis elaborates a brief overview of the interpretation of the term of the perpetrator and also of various typologies in forensic sciences. Particularly it is about criminology, criminalistics (behavioral analysis) and forensic psychology. This thesis also includes up-to-date data resulting from statistics kept by the Ministry of Justice and relating to the perpetrator of the crime.
