Abstract:

Diplomová práce se zabývá pojednáním o interních normativních instrukcích. Tyto paraprávní normativní akty představuje z hlediska pojmového, teoretického a praktického. Cílem práce je vymezení jejich obsahu, objasnění jejich postavení v právním systému a přiblížení problematiky jejich tvorby a vydávání. Práce je strukturovaná do tří základních tématických částí. První pojednává o charakteru interních normativních instrukcí, vymezuje jejich místo v soustavě správních aktů a provádí jejich druhovou systemizaci. Druhá část přináší teoretický výklad, který se zaměřuje na objasnění místa interních normativních instrukcí v právním systému, jejich porovnání s právními předpisy a na jejich význam a využití jako nástrojů řízení ve sféře veřejné správy. Třetí část zobecňuje praktické zkušenosti z jejich tvorby a vydávání. Zaměřuje se na organizaci procesu jejich vydávání, rozebírá zásady a pravidla jejich přípravy a stanovuje požadavky na formu a obsah. Součástí práce jsou i některé náměty de lege ferenda.

Abstract:

The diploma thesis deals with a discourse of by-law regulations. These paralaw normative acts are presented from the conceptual, theoretical and practical point of view. The aim of this work is to define their content, illustrate their position in the legal system and closely describe their creation and publishing. The work is structured into the three basic thematic parts. The first one addresses the nature of the by-law regulations, defines their place within the framework of administrative acts and performs their generic systemization. Second part provides theoretical interpretation, which focuses on the explanation of the position of the by-law regulations within the legal system, their comparison with the legal regulations and their importance and utilization as management tools in the public administration area. Third part generalizes practical experience from their creation and publishing. It focuses on organization of the process of their issuing, analyses the principles and rules of their preparation and determines the requirements of the form and content. Also, some ideas de lege ferenda are a part of the work.
