Abstract:

Abstrakt: Text byl zpracován za cílem ucelení poznatků o postavení církví a náboženských společností v právním řádu České republiky, konkrétně jeho vybraných aspektů ve vztahu k daňovým předpisům finančního práva. Zaměřuje se na hospodaření církví se zvláštním důrazem na zdanění jejich příjmů a porovnává jejich postavení s ostatními daňovými subjekty. K danému tématu přistupuje s ohledem na specifické charakter církví a náboženských společností, a zohledňuje také změnu jejich financování v návaznosti na majetkové vyrovnání. Dále se zabývá vztahem církví a naboženských společností ke státu obecně s doplněním historického kontextu nedávného vývoje ve 20. století. Cíle této práce byly naplněny především prostřednictvím analýzy daňových zákonů, veřejně dostupných informací o konrétních církvích a srovnáním platné právní s vybranými evropskými státy. Závěrem navrhuje možné alternativní modely regulace.

Abstract:

The goal of this thesis is to unify and present information about the legal status of churches and religious organizations in the law of the Czech Republic, especially its specific aspects with regard to tax regulations of the financial law. It focuses economic operations of churches, with special emphasis on the taxation on their income and compares them to other tax subjects. It approaches the topic with regard to the specific status of churches and religious organizations and reflects recent changes in their financing following restitution of their property. Another area of focus are the relations between churches and state in general with the addition of historical context and recent development in the 20th century. Its goals were met primarily through the analysis of tax laws, available information about specific churches and by comparing the current legislation with selected European countries. In its conclusion, it proposes alternative models of regulation.
