The Maintenance obligation between husbands, divorced husbands and registered partners

Abstract:

Diplomová práce se zabývá vyživovací povinností mezi manžely, rozvedenými manžely a registrovanými partnery. Obsah práce je rozdělen do čtyř kapitol. První kapitola se zabývá vyživovací povinností obecně, část této kapitoly je zaměřena na definici hlavních pojmů jako vyživovací povinnost, výživné, výživa, prameny práva a jednotlivé druhy vyživovací povinnosti, další část se věnuje společným pravidlům pro všechny druhy vyživovací povinnosti. Stěžejní část práce tvoří druhá až čtvrtá kapitola. Tyto kapitoly se věnují vybraným druhům vyživovací povinnosti - od jejich vzniku, přes rozsah vyživovací povinnosti, její výši při stanovení výživného soudem, zánik až po procesní stránku vyživovací povinnosti, tj. řízení o určení výživného. Diplomová práce se zaměřuje i na vyživovací povinnost v praxi. V rámci jednotlivých kapitol věnuje pozornost vybraným soudním rozhodnutím týkajících se vyživovací povinnosti.

Abstract:

The thesis deals with the maintenance obligation between husbands, divorced husbands and registered partners. The concept of this thesis is divided into four chapters. The first chapter deals with the maintenance obligation in general, the part of this chapter focuses on the definition of main terms as the maintenance obligation, maintenance, sustenance, the sources of law and kinds of maintenance obligation, another part deals with common rules including all kinds of maintenance obligation. The main part of this thesis is comprised of the second, third and fourth chapters. These chapters deal with individual types of maintenance obligation - from their existence, over the scope of the maintenance obligation, determining the amount of maintenance by the court, extincion and the procedural aspect of the maintenance obligation - the maintenance proceedings. The last chapter of this thesis deals with maintenance obligation in practice, the chapter is focused on the case law of courts of the Czech Republic related to maintenance obligation.
