Language versions of Community legal acts as a source of problems

Abstract:

Cílem této diplomové práce je formulovat problémy spojené s tvorbou a užíváním jazykových verzí práva ES a navrhnout jejich řešení tam, kde to přichází v úvahu. První část definuje právní rámec užívání jazykových verzí práva Společenství. Část druhá se zabývá obtížemi technického a ekonomického charakteru při tvorbě jednotlivých verzí. Jedna z jejích kapitol je věnována problému terminologické konzistence jednotlivých verzí a studiu právní povahy terminologických databází. Třetí část se věnuje problémům spojeným s neexistencí jedné či několika jazykových verzí, ať už se jedná o jejich naprostou absenci nebo nedostatky v řádné publikaci. Poslední část je zaměřena na problémy plynoucí z rozdílů mezi jednotlivými jazykovými verzemi téhož právního předpisu. Zkoumána jsou zde jak obecná interpretační pravidla, tak jejich užívání ve světle nové reality, kdy Unie užívá čtyřikrát více jazyků než v době, kdy se tato pravidla tvořila. Úplně nakonec je pozornost věnována procedurám změn jednotlivých verzí (bez novelizace předpisu samotného), zejména pak nedostatkům v jejich právním ukotvení, resp. jeho značné neprůhlednosti.

Abstract:

This dissertation intends to define the problems arising from the multilingualism of the European Union and suggest solutions where possible. The first part defines the legal framework of the use of language versions of Community acts. The second part examines the difficulties encountered when producing different language versions of Community legislation, in particular, those which are technical or economic in character. A separate chapter deals solely with the teminological consistency of every language version and the legal nature of terminological databases. The third part examines problems resulting from the absence of one or several language versions. This refers to either the total absence of a particular text or the failure to publish an existing act in the required form. The final part of this disseration considers problems resulting from differences in language versions of the same legal act. General rules of interpretation will be examined, as will their application in a Union which uses four times as many languages as it did when the rules were created. Finally, the procedures for modifying language versions (without modification of the original act) will be examined and it will be argued that there exists a certain lack of procedural transparency and control.
