Abstract:

Předkládaná práce si neklade za cíl být dílem, které by vyčerpávajícím a všezahrnujícím způsobem mapovalo veškeré nedostatky zákonodárství v ČR, včetně nedostatků obsahových. Mým cílem je spíše snaha prezentovat a přiblížit jiný možný úhel pohledu na zvolené téma, který představuje u nás nově vymezená teorie zákonodárství, přinášející komplexní právně-teoretický a sociálně-vědní výzkum problematiky zákonodárství, a skrze její aspekty se podrobněji pozastavit nad vybranými nedostatky zákonodárného procesu u nás, na které již opakovaně poukázala judikatura Ústavního soudu.Z toho důvodu naše soustředění bude věnováno především prostředkům či nástrojům (tzv. pojistkám ústavní konformity zákonodárného procesu) dozorujících a potenciálně kultivujících zákonodárný proces zvenčí, z nichž zcela dominantním je Ústavní soud v rámci své kompetence kontroly norem. Cílem této práce tak bude podrobněji zkoumat roli Ústavního soudu jako pojistky ústavní konformity zákonodárného procesu a skrze různé dimenze vztahu mezi ním a Parlamentem zhodnotit její efektivní působení vůči „zkratům“ v zákonodárné činnosti Parlamentu.

Abstract:

On the previous pages of my thesis: “Selected deficiencies of the legislative process from the perspective of the theory of legislation and decision-making of the Constitutional Court of the Czech Republic” I have tried to point out some deficiencies, problematic issues and questions related to the legislative process and legislation in the Czech Republic. This thesis does not aim to be a work which would exhaustively showed all the deficiencies in the legislation of the Czech Republic. The aim of this thesis is rather to present a different approach to research on the chosen topic, which represents a newly defined theory of legislation, which has been so far underestimated. This theory delivers complex legal-theoretical and social-science methods of research on legislation. Through its aspects is then provided a detailed examination of selected deficiencies of the legislative process in the Czech Republic, that were repeatedly points out in the case law of the Constitutional Court.
