Is there a right to be recognized as a third gender by the state?

Anotace:

Tato práce se po uvedení do teorie dané problematiky snažila vymezit legitimní potřebnost kategorie pohlaví v právním řádu. Dále učinila exkurz do právních řádů států, které již uznaly třetí pohlaví. A naposled analyzovala český právní řád tak, aby v něm nalezla právo na uznání člověka třetím pohlavím. Právo bylo nalezeno v judikatuře ESLP, konkrétně pod článkem 8 Úmluvy.

Abstract:

This thesis firstly introduced theoretical fundamentals of its theme, i. e. defined what are sex, gender, intersex people etc. so the readers would be knowlegdeable in this particular field of expertise. Then it looked for the legitimate need for the sex category in law. The thesis then took a look into the states which already recognized the third sex in their law. And finally it analyzed the law of the Czech republic to find the right to be recognized as a third sex by the state. In which the thesis was susccessful as the right is under the article 8 of the Convetion of the Human Rights. The specific arguments in favor of intersex people were found in the judgements of the ECtHR.
