Duplicate Record of Property Right in Land Register

Abstract:

ílem bakalářské práce je nejen poskytnout stručný přehled o druzích zápisu do katastru nemovitostí, ale především nastínit vznik duplicitního zápisu v katastru nemovitostí a jeho důsledky, které ovlivňují jak katastrální úřad tak také vlastníky dotčených nemovitostí. Duplicitní záznam vlastnického práva v katastru nemovitostí je jeden z nejzávažnějších problémů, který může při záznamu vlastnického práva nastat. Problematika duplicitního zápisu souvisí se způsobem zápisu práv do katastru nemovitostí a častou příčinou je nedůsledná evidence nemovitostí v dřívější době. Duplicitní zápis může vzniknout pouze při zápisu práv, která vznikají ze zákona nebo rozhodnutím státního orgánu, tzv. záznamem. Záznam je úkon katastrálního úřadu, který nemá vliv na vznik, změnu nebo zánik práva k nemovitostem. Je to jedna z forem zápisu do katastru, ale z mého pohledu ta nejproblematičtější. Záznam má pouze evidenční charakter. Listiny, podle kterých se provádí záznam do katastru, mají úředníci katastrálního úřadu pravomoc zkoumat jen v oblasti chyb v psaní či počtech a bez jiných zřejmých nesprávností. Pokud se katastrální úřad domnívá, že listina obsahuje nesprávné údaje, které však nelze podřadit pod chyby v psaní, počtech nebo jiné zřejmé nesprávnosti, nemá možnost provedení záznamu odmítnout. A tímto vzniká celý problém duplicitního zápisu vlastnictví v katastru. I když katastrální úřad v listu vlastnictví vidí, že vlastnické právo k nemovitosti má zapsané už jiný osoba, nemůže případ řešit, ale automaticky musí dalšího vlastníka zapsat. Vzhledem k tomu, že v dřívější době byly státními orgány vydávány nebo registrovány listiny dokládající převody vlastnictví, i když šlo o převody od nevlastníků, a ty byly následně zapisovány do dřívější evidence nemovitostí, řada listin předkládaných k záznamu neosvědčuje skutečný právní stav. Typicky kolizními listinami, které zakládají duplicitní zápis vlastnictví v katastru nemovitostí, jsou např. rozhodnutí dědictví, kdy do soupisu dědictví byly chybně zahrnuty nemovitosti již dříve převedené na jinou osobu, listiny o nabytí vlastnictví v privatizaci či restituci a další případy, kdy podkladem soudního rozhodnutí byly smlouvy o převodu nemovitosti od nevlastníka. Podle mého názoru by nejjednodušší řešení bylo obnovení intabulačního principu u všech zápisů vlastnických práv k nemovitostem. Katastrální úřad by pak měl dostatečnou pravomoc k přezkoumání listin, které jsou součástí žádost o záznam do katastru. Zároveň by zde vznikla i možnost opravného prostředku proti každému neprovedení zápisu. Vhodné by také bylo obnovit tzv. intabulační doložku. To by znamenalo, že žádný zápis právního vztahu nebude proveden na úkor dosud zapsaného vlastníka nemovitosti bez jeho předchozího souhlasu. Takže by každý, na jehož úkor byl v katastru zápis proveden, měl být o provedeném zápisu vyrozuměn dopisem doručeným do vlastních rukou, či jiným prokazatelným způsobem. Výjimkou by byly zápisy exekučního charakteru. Protože, by nebylo vhodné, aby vlastník na jehož nemovitost je vystaven exekuční titul, zdržoval exekuční řízení, tím, že si například nepřevezme dopis určený do vlastních rukou. Ať došlo k provedení duplicitního zápisu z jakýchkoli důvodů, je tento zápis nežádoucí a takto zapsaní vlastníci by měli své právní poměry v co možná nejkratší době řádně uspořádat. Prvořadá by měla být dohoda narovnání, ale bohužel častější řešení sporu je cesta soudní. A tím samozřejmě dochází k zbytečnému zahlcení našich soudů.

Abstract:

The aim of this bachelor thesis is not only to provide a brief overview of the types of land registration, but also outline the creation of duplicate registration in the land and its consequences, which affect both the land registry office as well as owners of the property. Duplicate record of the ownership in the land registration is one of the most serious problems, which can appear in the land registation process. The issue of duplicate registration is related to the ways of right registration in (real estate) and mainly caused by inconsistent evidence of real estate in past. Duplicate entry can occur only when the registration of rights arises from the act or decision of a state organ, so called a record. The record is the act of the landscape registration office, which does not affect the creation, modification or termination of the rights to property. It is one of the forms of land registration, but in my opinion the most problematic one. The records has only a registered and informative character. The documents, under which the registration is carried into the land record, land registry officers have jurisdiction to consider only the error in writing or counting and other obvious errors. If a cadastral authority considers that the document contains incorrect data that can not be subsumed under the error in writing, numbers, or other obvious errors, does not have the possibility to reject the recording. And this is basicly the whole issue of duplicate registration of property in land. Although the Land Registry can see in the document that the ownrship right to the property has been already registered by someone else, can not solve this issue, but the next owner will automatically be registered. In past, the former state authorities issued or registered deeds transfer ownership, even if the transfers was from non-owners, and they were subsequently written to the previous real estate records, therefore a number of documents submitted for recording do not have a true legal status. The typically example of conflict documents, which constitute the duplicate registration of ownership in real estate are inheritance decisions when the inventory of heritage have been erroneously included property previously transferred to another person, the instrument of acquisition of ownership in the privatization and restitution, and other cases where the underlying jurisdical decision was based on the contracts for the transfer of property from non-owner. In my opinion, the simplest solution is to restore the principle of „instabulacni“ in all records of ownership of the property regiastration. Cadastral Authority would then have sufficient authority to review documents that are part of an application for entry in the register. At the same time there would be the possibility of appeal against any refusal to register. It would also be appropriate to restore the so-called intabulační clause. This would mean that no registration of the legal relationship will be made at the expense of yet registered owner of the property without his prior consent. In this case, everyone who was carried out on the registration, should be informed by letter delivered by hand, or other verifiable manner. The exception would be with entries of enforcement nature. Because it would not be appropriate that the property owner on whose title is subject to execution, would have a chance to postpone the process by e.g. not pick up the letter into their own hands. No matter the reason of the duplicate registration, such registration is undesirable and therefore owners should organize their legal situation properly in the shortest possible time. The best way would be paramount settlement agreement, but unfortunately more common outcome is the legal way. And this of course leads to unnecessary congestion of our courts.
