Employment of foreigners in the Czech Republic

Abstract:

Tématem diplomové práce je zaměstnávání cizinců v České republice. Jejím cílem je analýza aktuálního stavu v oblasti zaměstnávání zahraničních pracovníků na území České republiky a zároveň vypracování užitečného postupu pro zaměstnavatele v rámci pracovněprávních vztahů s cizinci. Práce je rozdělená na teoretickou a praktickou část. V teoretické části jsou na začátku vymezené základní pojmy jako cizinec, pobyt cizinců a trh práce. Následně jsou pojmenované základní prameny právní úpravy zaměstnávání osob ze zahraničí. Třetí kapitola obsahuje nejen informace o právní regulaci možností zahraničních pracovníků pracovat v ČR, ale zahrnuje i příklady pro lepší pochopení problematiky. Čtvrtá kapitola je věnovaná vládním programům ekonomické migrace cizinců, jsou vymezené její hlavní atributy a provedeno je srovnání. Další část práce obsahuje okrajové informace ohledně možností zaměstnávání cizinců v rámci agenturního zaměstnávání. Poslední kapitola je více praktická, orientuje se na problematiku a účelnost zaměstnávání cizinců pro zaměstnavatele, kteří tento krok plánují. Zároveň se tato část snaží propojit teoretickou část s praxí prostřednictvím příkladů a modelování různých situací a současně také upozornit na některé problémy, které mohou vzniknout, a navrhnout, jak by bylo možné jim předcházet.

Abstract:

The diploma thesis is focused on the employment of foreigners in the Czech Republic. The aim of this research is to analyze the current situation in the area of the foreign workers’ employment in the territory of the Czech Republic, as well as to develop a useful instruction for employers in the labor employment field. The thesis is divided into theoretical and practical parts. The theoretical part defines basic terms, such as foreigner, residence of foreigners and the labor market. Subsequently, the basic sources of legal regulation of foreigners’ employment in the Czech Republic are named. The third chapter describes not only information about the legal regulation of possibility for foreign employees to work in the Czech Republic, but also examples for a better understanding of the problematics. The fourth chapter is devoted to government programs of foreigners’economic migration and their main attributes along with its comparison. The next part of the thesis contains information about the possibilities of employing foreigners in the framework of agency employment. The final chapter is more practical in terms of problematics and expediency for an employer, who will likely be employing foreigners. Simultaneously, on the basis of an effort to connect the theoretical part with practice by way of examples and modeling of various situations, this part highlights some problems that might occur during the process and ways of their prevention.
