Professional secrecy duty in tax procedure

Abstract:

Tato bakalářská práce se v úvodní části zabývá důležitými pojmy základního právního předpisu, tj. zákona č. 280/2009 Sb., daňový řád, upravujícího procesní pravidla při správě daní, zahrnující úpravu postupu správců daně a úpravu práv a povinností daňových subjektů a třetích osob vznikajících v souvislosti se správou daní. Obsahem úvodní části práce je vysvětlení pojmů jako správa daní, daňové řízení, daň, správce daně, dále pak osoby zúčastněné na správě daní, tj. daňový subjekt a třetí osoby. Těžiště práce je věnováno zejména rozboru institutu povinné mlčenlivosti, který provádí zásadu neveřejnosti správy daní. Bakalářská práce tak obsahuje obecný výklad pojmu "mlčenlivost", dále následuje podrobný rozbor povinné mlčenlivosti jak správce daně, tak účastníků řízení a to jak z hlediska obecné úpravy v daňovém řádu, tak z hlediska úpravy zakotvené ve zvláštních právních předpisech, upravujících ochranu soukromí a povinnou mlčenlivost v českém právním řádu. V závěru pak práce obsahuje zhodnocení současného stavu s uvedením konkrétních poznatků z praxe.

Abstract:

The introduction of this bachelor thesis deals with the important terms of the basic legislation, i.e. the Act No. 280/2009 Coll., the tax code, that covers procedural rules of the administration process, including the procedural rules of tax administrators and the rules of taxpayers´ and third parties´ rights and obligations that arise in connection with the tax administration. The content of the introduction of the work is an explanation of terms such as tax administration, tax procedure, tax, tax administrator and also the persons involved in the tax administration, i.e. taxpayer and third party. The main part of the work is focused on the analysis of the institute of obligate confidentiality that procces the non-public principle of the tax administration. The bachelor thesis contains the general interpretation of the term "confidentialily". It also contents the detailed analysis of obligate confidentiality related to the both tax administrators and the parties. That is described in terms of the general tax rules as well as in terms of the specific tax legislation governing privacy policy and the obligate confidentiality in the Czech law. The conclusion of the work includes the evaluation and comparison of the actuall status with concrete knowledges from real life.
